GENERAL PRINCIPLES ON THE PROCUREMENT OF<br />

CONSULTING SERVICES<br />

1. DEFINITION OF A CONSULTANT<br />

A natural or juridical person, qualified by appropriate education, training and relevant experience<br />

to render any or all <strong>of</strong> <strong>the</strong> types and fields <strong>of</strong> <strong>consulting</strong> <strong>service</strong>s as defined in this IRR, shall be<br />

considered as a “Consultant,” subject to <strong>the</strong> requirements provided in <strong>the</strong> revised IRR <strong>for</strong> eligibility<br />

check and post-qualification.<br />

2. THE NEED FOR CONSULTANTS<br />

The <strong>service</strong>s <strong>of</strong> consultants may be engaged by any procuring entity <strong>for</strong> government projects or<br />

related activities <strong>of</strong> such magnitude and/or scope as would require a level <strong>of</strong> expertise or attention<br />

beyond <strong>the</strong> optimum in-house capability <strong>of</strong> <strong>the</strong> procuring entity concerned and consistent with <strong>the</strong><br />

Government‟s policy not to compete with <strong>the</strong> private sector.<br />

3. INDEPENDENCE OF CONSULTANTS<br />

To ensure <strong>the</strong> consultant‟s pr<strong>of</strong>essional independence, integrity, and objectivity, consultants, as<br />

well as key staff working <strong>for</strong> <strong>the</strong> <strong>consulting</strong> entity, who may be directly or indirectly associated with<br />

non-<strong>consulting</strong> firms that may have an interest in or bias towards <strong>the</strong> project concerned, shall be<br />

selected only if <strong>the</strong>y agree to limit <strong>the</strong>ir role to that <strong>of</strong> consultants and will disqualify <strong>the</strong>mselves<br />

and <strong>the</strong>ir affiliates <strong>for</strong> bidding <strong>for</strong> products and <strong>service</strong>s <strong>of</strong> <strong>the</strong> same government project.<br />

4. HIRING OF CONSULTANTS<br />

4.1. Consultants shall be hired on <strong>the</strong> basis <strong>of</strong> <strong>the</strong>ir proven expertise, experience and<br />

capability. Under certain conditions provided herein, cost may be included as a factor in<br />

<strong>the</strong> selection <strong>of</strong> consultants.<br />

4.2. In order to manifest trust and confidence in and promote <strong>the</strong> development <strong>of</strong> Filipino<br />

consultancy, Filipino consultants shall be hired whenever <strong>the</strong> <strong>service</strong>s required <strong>for</strong> <strong>the</strong><br />

project are within <strong>the</strong> expertise and capability <strong>of</strong> Filipino consultants: Provided, however,<br />

That in <strong>the</strong> event Filipino consultants do not have <strong>the</strong> sufficient expertise and capability to<br />

render <strong>the</strong> <strong>service</strong>s required under <strong>the</strong> project, as determined by <strong>the</strong> HOPE, <strong>for</strong>eign<br />

consultants may be hired.<br />

4.3. In <strong>the</strong> hiring <strong>of</strong> <strong>for</strong>eign consultants, all pertinent laws and regulations <strong>of</strong> <strong>the</strong> Philippines<br />

shall be followed.<br />

4.4. Technology and knowledge transfer to <strong>the</strong> procuring entity shall be required in <strong>the</strong><br />

provision <strong>of</strong> <strong>consulting</strong> <strong>service</strong>s, where applicable.<br />
