4. PROCEDURES
3.7.13 Failure of all short listed consultant to pass the preliminary
examination of bids
If no short listed consultant passes the preliminary examination of bids, the
BAC should declare the bidding a failure. In such a case, the BAC shall
issue a Resolution declaring a failure of bidding. In order to determine the
reason for the failed bidding, the BAC shall conduct a mandatory review and
evaluation of the terms, conditions, and specifications in the Bidding
Documents, including its cost estimates (Section 35.2 of the revised IRR).
Based on its findings, the BAC shall revise the terms, conditions, and
specifications, and if necessary, adjust the ABC, subject to the required
approvals, and conduct a re-bidding with re-advertisement and/or posting,
as provided for in Section 21.2 (Section 35.3 of the revised IRR 35.3). All
bidders who have initially responded to the REI and have been declared
eligible or short listed in the previous biddings shall be allowed to submit new
bids. The BAC shall observe the same process and set the new periods
according to the same rules followed during the previous bidding
(Section35.4 of the revised IRR).
Should there occur a second failure of bidding, the procuring entity may
resort to negotiated procurement, as provided for in Section 53.1 of the
revised IRR of R.A. 9184 (Section 35.5 of the revised IRR).
The following steps are undertaken in the receipt, opening and preliminary examination of bids:
4.1. Bidders shall submit their bids through their duly authorized representative using the forms
specified in the Bidding Documents in two (2) separate sealed bid envelopes, and which
shall be submitted simultaneously. The first shall contain the technical component of the
bid and the second shall contain the financial component of the bid (Section 25.1 of the
revised IRR).
4.2. The BAC shall open the bids at the time, date, and place specified in the Bidding
Documents. The bidders or their duly authorized representatives may attend the opening
of bids. The BAC shall adopt a procedure for ensuring the integrity, security, and
confidentiality of all submitted bids. The minutes of the bid opening shall be made available
to the public upon written request and payment of a specified fee to recover cost of
materials (Section 29 of the revised IRR).
4.3. The BAC shall open the first bid envelopes of prospective bidders in public to determine
each bidder‟s compliance with the documents required to be submitted, as prescribed in
Section 25.2 of the revised IRR of R.A. 9184. For this purpose, the BAC shall check the
