4. PROCEDURES<br />

3.7.13 Failure <strong>of</strong> all short listed consultant to pass <strong>the</strong> preliminary<br />

examination <strong>of</strong> bids<br />

If no short listed consultant passes <strong>the</strong> preliminary examination <strong>of</strong> bids, <strong>the</strong><br />

BAC should declare <strong>the</strong> bidding a failure. In such a case, <strong>the</strong> BAC shall<br />

issue a Resolution declaring a failure <strong>of</strong> bidding. In order to determine <strong>the</strong><br />

reason <strong>for</strong> <strong>the</strong> failed bidding, <strong>the</strong> BAC shall conduct a mandatory review and<br />

evaluation <strong>of</strong> <strong>the</strong> terms, conditions, and specifications in <strong>the</strong> Bidding<br />

Documents, including its cost estimates (Section 35.2 <strong>of</strong> <strong>the</strong> revised IRR).<br />

Based on its findings, <strong>the</strong> BAC shall revise <strong>the</strong> terms, conditions, and<br />

specifications, and if necessary, adjust <strong>the</strong> ABC, subject to <strong>the</strong> required<br />

approvals, and conduct a re-bidding with re-advertisement and/or posting,<br />

as provided <strong>for</strong> in Section 21.2 (Section 35.3 <strong>of</strong> <strong>the</strong> revised IRR 35.3). All<br />

bidders who have initially responded to <strong>the</strong> REI and have been declared<br />

eligible or short listed in <strong>the</strong> previous biddings shall be allowed to submit new<br />

bids. The BAC shall observe <strong>the</strong> same process and set <strong>the</strong> new periods<br />

according to <strong>the</strong> same rules followed during <strong>the</strong> previous bidding<br />

(Section35.4 <strong>of</strong> <strong>the</strong> revised IRR).<br />

Should <strong>the</strong>re occur a second failure <strong>of</strong> bidding, <strong>the</strong> procuring entity may<br />

resort to negotiated <strong>procurement</strong>, as provided <strong>for</strong> in Section 53.1 <strong>of</strong> <strong>the</strong><br />

revised IRR <strong>of</strong> R.A. 9184 (Section 35.5 <strong>of</strong> <strong>the</strong> revised IRR).<br />

The following steps are undertaken in <strong>the</strong> receipt, opening and preliminary examination <strong>of</strong> bids:<br />

4.1. Bidders shall submit <strong>the</strong>ir bids through <strong>the</strong>ir duly authorized representative using <strong>the</strong> <strong>for</strong>ms<br />

specified in <strong>the</strong> Bidding Documents in two (2) separate sealed bid envelopes, and which<br />

shall be submitted simultaneously. The first shall contain <strong>the</strong> technical component <strong>of</strong> <strong>the</strong><br />

bid and <strong>the</strong> second shall contain <strong>the</strong> financial component <strong>of</strong> <strong>the</strong> bid (Section 25.1 <strong>of</strong> <strong>the</strong><br />

revised IRR).<br />

4.2. The BAC shall open <strong>the</strong> bids at <strong>the</strong> time, date, and place specified in <strong>the</strong> Bidding<br />

Documents. The bidders or <strong>the</strong>ir duly authorized representatives may attend <strong>the</strong> opening<br />

<strong>of</strong> bids. The BAC shall adopt a procedure <strong>for</strong> ensuring <strong>the</strong> integrity, security, and<br />

confidentiality <strong>of</strong> all submitted bids. The minutes <strong>of</strong> <strong>the</strong> bid opening shall be made available<br />

to <strong>the</strong> public upon written request and payment <strong>of</strong> a specified fee to recover cost <strong>of</strong><br />

materials (Section 29 <strong>of</strong> <strong>the</strong> revised IRR).<br />

4.3. The BAC shall open <strong>the</strong> first bid envelopes <strong>of</strong> prospective bidders in public to determine<br />

each bidder‟s compliance with <strong>the</strong> documents required to be submitted, as prescribed in<br />

Section 25.2 <strong>of</strong> <strong>the</strong> revised IRR <strong>of</strong> R.A. 9184. For this purpose, <strong>the</strong> BAC shall check <strong>the</strong><br />
