STEP5. CONDUCT PRE-BID CONFERENCE AND<br />

ISSUE SUPPLEMENTAL BID BULLETINS<br />

1. LEGAL REFERENCE<br />

Section 22 <strong>of</strong> <strong>the</strong> revised IRR is <strong>the</strong> legal basis in conducting pre-bid conference and issue<br />

supplemental bid bulletins.<br />

2. PURPOSE<br />

The pre-bid conference is <strong>the</strong> initial <strong>for</strong>um where <strong>the</strong> Procuring Entity‟s representatives and <strong>the</strong><br />

prospective bidders discuss <strong>the</strong> different aspects <strong>of</strong> <strong>the</strong> <strong>procurement</strong> at hand. Its object is to clarify<br />

and/or explain any <strong>of</strong> <strong>the</strong> requirements, terms, conditions, and specifications stipulated in <strong>the</strong><br />

Bidding Documents.<br />

It is important that responsible and knowledgeable <strong>of</strong>ficials attend <strong>the</strong> conference. The persons<br />

who actually <strong>for</strong>mulated <strong>the</strong> Terms <strong>of</strong> Reference <strong>for</strong> <strong>the</strong> project should be present among those<br />

representing <strong>the</strong> Procuring Entity. Short listed consultants, on <strong>the</strong> o<strong>the</strong>r hand, should be<br />

encouraged to send representatives who are legally and technically knowledgeable about <strong>the</strong><br />

requirements <strong>of</strong> <strong>the</strong> <strong>procurement</strong> at hand. It is also important that <strong>the</strong> short listed consultants be<br />

given ample time to review <strong>the</strong> bidding documents prior to <strong>the</strong> pre-bid conference.<br />

3. RULES AND GUIDELINES<br />

3.1 Threshold in holding a Pre-bid Conference<br />

According to Section 22.1 <strong>of</strong> <strong>the</strong> revised IRR, <strong>the</strong> BAC shall convene a pre-bid conference<br />

to clarify and/or explain any <strong>of</strong> <strong>the</strong> requirements, terms, conditions, and specifications<br />

stipulated in <strong>the</strong> Bidding Documents in <strong>the</strong> following instances:<br />

a. At least once <strong>for</strong> contracts to be bid with an ABC <strong>of</strong> One Million Pesos (PhP<br />

1,000,000.00) or more;<br />

b. At <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> BAC <strong>for</strong> contracts to be bid with an ABC <strong>of</strong> less than One<br />

Million Pesos (PhP 1, 000,000.00);<br />

c. Subject to <strong>the</strong> approval <strong>of</strong> <strong>the</strong> BAC, a pre-bid conference may also be conducted<br />

upon written request <strong>of</strong> any prospective bidder.<br />

3.2 Period <strong>of</strong> action<br />

The pre-bid conference must be held at least twelve (12) calendar days be<strong>for</strong>e <strong>the</strong><br />

deadline <strong>for</strong> <strong>the</strong> submission and receipt <strong>of</strong> bids. If <strong>the</strong> procuring entity determines that, by<br />

reason <strong>of</strong> <strong>the</strong> method, nature, or complexity <strong>of</strong> <strong>the</strong> contract to be bid or when international<br />

participation will be more advantageous to <strong>the</strong> GOP, a longer period <strong>for</strong> <strong>the</strong> preparation <strong>of</strong><br />
