MANUAL PROCEDURES FOR THE PROCUREMENT OF CONSULTING SERVICES<br />

Procuring Entity should make available to all <strong>the</strong> short listed consultants toge<strong>the</strong>r with <strong>the</strong><br />

request <strong>for</strong> proposals all in<strong>for</strong>mation that would in that respect give a consultant a<br />

competitive advantage.<br />

3.5 Submission <strong>of</strong> Eligibility Requirements<br />

The eligibility envelopes <strong>of</strong> prospective bidders <strong>for</strong> <strong>procurement</strong> <strong>of</strong> <strong>consulting</strong> <strong>service</strong>s shall<br />

be submitted on or be<strong>for</strong>e <strong>the</strong> deadline specified in <strong>the</strong> REI, and shall be opened be<strong>for</strong>e<br />

<strong>the</strong> dates <strong>of</strong> <strong>the</strong> pre-bid conference and bid opening to determine eligibility <strong>of</strong> prospective<br />

bidders, who shall <strong>the</strong>n be allowed to acquire or purchase <strong>the</strong> relevant Bidding Documents<br />

from <strong>the</strong> procuring entity. A prospective bidder may be allowed to submit his eligibility<br />

requirements electronically in accordance with Section 8.5 <strong>of</strong> <strong>the</strong> revised IRR (Section<br />

24.4.1 <strong>of</strong> <strong>the</strong> revised IRR).<br />

3.5.1 Only one bidder submits an Eligibility Envelope<br />

Even if only one bidder submits its eligibility envelope, <strong>the</strong> bidding process<br />

continues. If it is declared eligible, passes short listings, and its bid is found to be<br />

responsive to <strong>the</strong> bidding requirements, its bid will be declared as a Single Rated<br />

and Responsive Bid and considered <strong>for</strong> contract award (Section 36 <strong>of</strong> <strong>the</strong><br />

revised IRR).<br />

3.5.2 Participants in <strong>the</strong> Receipt and Opening <strong>of</strong> <strong>the</strong> Eligibility Envelopes<br />

The following parties participate in <strong>the</strong> eligibility check/screening:<br />

a. BAC;<br />

b. TWG;<br />

c. Secretariat;<br />

d. Prospective bidders;<br />

e. Observers; and,<br />

f. COA Representative.<br />

3.5.3 Recourse <strong>of</strong> potential bidder if found ineligible<br />

Decisions <strong>of</strong> <strong>the</strong> BAC at any stage <strong>of</strong> <strong>the</strong> <strong>procurement</strong> process may be questioned<br />

by filing a request <strong>for</strong> reconsideration within <strong>the</strong> three (3) calendar days upon<br />

receipt <strong>of</strong> written notice or upon verbal notification. The BAC shall decide on <strong>the</strong><br />

request <strong>for</strong> reconsideration within seven (7) calendar days from receipt <strong>the</strong>re<strong>of</strong>.<br />

If a failed bidder signifies his intent to file a request <strong>for</strong> reconsideration, <strong>the</strong> BAC<br />

shall keep <strong>the</strong> eligibility envelopes <strong>of</strong> <strong>the</strong> said failed bidder duly sealed until such<br />
