MANUAL PROCEDURES FOR THE PROCUREMENT OF CONSULTING SERVICES<br />

contract is <strong>the</strong> result <strong>of</strong> a Competitive Bidding; (b) <strong>the</strong> subject contract to be<br />

negotiated has similar or related scopes <strong>of</strong> work; (c) it is within <strong>the</strong> contracting<br />

capacity <strong>of</strong> <strong>the</strong> contractor/consultant; (d) <strong>the</strong> contractor/consultant uses <strong>the</strong> same<br />

prices or lower unit prices as in <strong>the</strong> original contract less mobilization cost; (e) <strong>the</strong><br />

amount involved does not exceed <strong>the</strong> amount <strong>of</strong> <strong>the</strong> ongoing project; and (f) <strong>the</strong><br />

contractor/consultant has no negative slippage/delay: Provided, fur<strong>the</strong>r, that<br />

negotiations <strong>for</strong> <strong>the</strong> <strong>procurement</strong> are commenced be<strong>for</strong>e <strong>the</strong> expiry <strong>of</strong> <strong>the</strong> original<br />

contract;<br />

2.2.5 Agency-to-Agency<br />

Procurement <strong>of</strong> infrastructure projects, <strong>consulting</strong> <strong>service</strong>s, and goods from<br />

ano<strong>the</strong>r agency <strong>of</strong> <strong>the</strong> GOP, such as <strong>the</strong> PS-DBM, which is tasked with a<br />

centralized <strong>procurement</strong> <strong>of</strong> Common-Use Supplies <strong>for</strong> <strong>the</strong> GOP in accordance with<br />

Letters <strong>of</strong> Instruction No. 755 and Executive Order No. 359, series <strong>of</strong> 1989;<br />

2.2.6 Procurement Agent<br />

In order to hasten project implementation, Procuring Entities which may not have<br />

<strong>the</strong> pr<strong>of</strong>iciency or capability to undertake a particular <strong>procurement</strong>, as determined<br />

by <strong>the</strong> Head <strong>of</strong> <strong>the</strong> Procuring Entity concerned, may request o<strong>the</strong>r GOP agencies<br />

to undertake such <strong>procurement</strong> <strong>for</strong> <strong>the</strong>m, or at <strong>the</strong>ir option, recruit and hire<br />

consultants or <strong>procurement</strong> agents to assist <strong>the</strong>m directly and/or train <strong>the</strong>ir staff in<br />

<strong>the</strong> management <strong>of</strong> <strong>the</strong> <strong>procurement</strong> function. The GPPB shall issue guidelines to<br />

implement this provision;<br />

2.2.7 Highly Technical Consultants<br />

In <strong>the</strong> case <strong>of</strong> individual consultants hired to do work that is (i) highly technical or<br />

proprietary; or (ii) primarily confidential or policy determining, where trust and<br />

confidence are <strong>the</strong> primary consideration <strong>for</strong> <strong>the</strong> hiring <strong>of</strong> <strong>the</strong> consultant: Provided,<br />

however, that <strong>the</strong> term <strong>of</strong> <strong>the</strong> individual consultants shall, at <strong>the</strong> most, be on a six<br />

(6) month basis, renewable at <strong>the</strong> option <strong>of</strong> <strong>the</strong> appointing Head <strong>of</strong> <strong>the</strong> Procuring<br />

Entity, but no case shall exceed <strong>the</strong> term <strong>of</strong> <strong>the</strong> latter (Section 53.7 <strong>of</strong> <strong>the</strong> revised<br />

IRR).<br />

2.2.8 Small Value Procurement<br />

Where <strong>the</strong> <strong>procurement</strong> does not fall under Shopping in Section 52 <strong>of</strong> <strong>the</strong> revised<br />

IRR and <strong>the</strong> amount involved does not exceed <strong>the</strong> thresholds prescribed in Annex<br />

“H” <strong>of</strong> <strong>the</strong> revised IRR:<br />

a. The procuring entity shall draw up a list <strong>of</strong> at least three (3) suppliers,<br />

contractors, or consultants <strong>of</strong> known qualifications which will be invited to<br />

submit proposals, in <strong>the</strong> case <strong>of</strong> goods and infrastructure projects, or<br />

curriculum vitae, in <strong>the</strong> case <strong>of</strong> <strong>consulting</strong> <strong>service</strong>s;<br />
