Immediately after <strong>the</strong> BAC has notified <strong>the</strong> first bidder <strong>of</strong> its post-disqualification,<br />

and notwithstanding any pending request <strong>for</strong> reconsideration <strong>the</strong>re<strong>of</strong>, <strong>the</strong> BAC<br />

shall initiate and complete <strong>the</strong> same post-qualification process on <strong>the</strong> bidder with<br />

<strong>the</strong> second HRB. If <strong>the</strong> second bidder passes <strong>the</strong> post-qualification, and provided<br />

that <strong>the</strong> request <strong>for</strong> reconsideration <strong>of</strong> <strong>the</strong> first bidder has been denied, <strong>the</strong> second<br />

bidder shall be post-qualified as <strong>the</strong> bidder with <strong>the</strong> Highest Rated Responsive Bid<br />

(Section 34.6 <strong>of</strong> <strong>the</strong> Revised IRR).<br />

If <strong>the</strong> second bidder, however, fails <strong>the</strong> post-qualification, <strong>the</strong> procedure <strong>for</strong> postqualification<br />

shall be repeated <strong>for</strong> <strong>the</strong> bidder with <strong>the</strong> next HRB, and so on until <strong>the</strong><br />

HRRB, as <strong>the</strong> case may be, is determined <strong>for</strong> award, subject to Section 37 <strong>of</strong> <strong>the</strong><br />

revised IRR (Section 34.7 <strong>of</strong> <strong>the</strong> revised IRR).<br />

3.7 Failure <strong>of</strong> all qualified bidders to pass post-qualification<br />

4. PROCEDURES<br />

If no bidder passes post-qualification, <strong>the</strong> BAC should declare <strong>the</strong> bidding a failure. In such<br />

a case, <strong>the</strong> BAC shall issue a Resolution declaring a failure <strong>of</strong> bidding. In order to<br />

determine <strong>the</strong> reason <strong>for</strong> <strong>the</strong> failed bidding, <strong>the</strong> BAC shall conduct a mandatory review and<br />

evaluation <strong>of</strong> <strong>the</strong> terms, conditions, and specifications in <strong>the</strong> Bidding Documents, including<br />

its cost estimates (Section 35.2 <strong>of</strong> <strong>the</strong> revised IRR). Based on its findings, <strong>the</strong> BAC shall<br />

revise <strong>the</strong> terms, conditions, and specifications, and if necessary, adjust <strong>the</strong> ABC, subject<br />

to <strong>the</strong> required approvals, and conduct a re-bidding with re-advertisement and/or posting,<br />

as provided <strong>for</strong> in Section 21.2 (Section 35.3 <strong>of</strong> <strong>the</strong> revised IRR 35.3). All bidders who<br />

have initially responded to <strong>the</strong> REI and have been declared eligible or short listed in <strong>the</strong><br />

previous biddings shall be allowed to submit new bids. The BAC shall observe <strong>the</strong> same<br />

process and set <strong>the</strong> new periods according to <strong>the</strong> same rules followed during <strong>the</strong> previous<br />

bidding (Section 35.4 <strong>of</strong> <strong>the</strong> revised IRR).<br />

Should <strong>the</strong>re occur a second failure <strong>of</strong> bidding, <strong>the</strong> procuring entity may resort to<br />

negotiated <strong>procurement</strong>, as provided <strong>for</strong> in Section 53.1 <strong>of</strong> <strong>the</strong> revised IRR <strong>of</strong> R.A. 9184<br />

(Section 35.5 <strong>of</strong> <strong>the</strong> revised IRR).<br />

The following steps are followed in <strong>the</strong> conduct <strong>of</strong> post-qualification:<br />

a. The BAC, through <strong>the</strong> Secretariat, shall notify <strong>the</strong> consultant with <strong>the</strong> HRB to submit<br />

additional documentary requirements as enumerated in Section 34.2 <strong>of</strong> <strong>the</strong> revised IRR<br />

and Section 3.4 <strong>of</strong> this manual to facilitate with <strong>the</strong> conduct <strong>of</strong> post-qualification. Noncompliance<br />

<strong>of</strong> <strong>the</strong> consultant with <strong>the</strong> HRB shall be ground <strong>for</strong> <strong>the</strong> <strong>for</strong>feiture <strong>of</strong> <strong>the</strong> bid<br />

security tendered and <strong>the</strong> cause <strong>for</strong> disqualification.<br />

b. The BAC/TWG verifies, validates, and ascertains <strong>the</strong> genuineness, validity and accuracy<br />

<strong>of</strong> <strong>the</strong> legal, technical and financial documents submitted by <strong>the</strong> bidder with <strong>the</strong> LCB, using<br />

<strong>the</strong> non-discretionary criteria described above.<br />
