3.3 No eligible bidder passes short listing<br />

4. PROCEDURES<br />

If no prospective bidder is short listed, <strong>the</strong> BAC should declare <strong>the</strong> bidding a failure. In<br />

such a case, <strong>the</strong> BAC shall issue a Resolution declaring a failure <strong>of</strong> bidding. In order to<br />

determine <strong>the</strong> reason <strong>for</strong> <strong>the</strong> failed bidding, <strong>the</strong> BAC shall conduct a mandatory review<br />

and evaluation <strong>of</strong> <strong>the</strong> terms, conditions, and specifications in <strong>the</strong> Bidding Documents,<br />

including its cost estimates (Section 35.2 <strong>of</strong> <strong>the</strong> revised IRR). Based on its findings, <strong>the</strong><br />

BAC shall revise <strong>the</strong> terms, conditions, and specifications, and if necessary, adjust <strong>the</strong><br />

ABC, subject to <strong>the</strong> required approvals, and conduct a re-bidding with re-advertisement<br />

and/or posting, as provided <strong>for</strong> in Section 21.2 <strong>of</strong> <strong>the</strong> revised IRR (Section 35.3 <strong>of</strong> <strong>the</strong><br />

revised IRR). All bidders have initially responded to <strong>the</strong> REI and have been declared<br />

eligible or short listed in <strong>the</strong> previous biddings shall be allowed to submit new bids. The<br />

BAC shall observe <strong>the</strong> same process and set <strong>the</strong> new periods according to <strong>the</strong> same<br />

rules followed during <strong>the</strong> previous bidding (Section 35.4 <strong>of</strong> <strong>the</strong> revised IRR).<br />

Should <strong>the</strong>re occur a second failure <strong>of</strong> bidding, <strong>the</strong> procuring entity may resort to<br />

negotiated <strong>procurement</strong>, as provided <strong>for</strong> in Section 53.1 <strong>of</strong> <strong>the</strong> revised IRR <strong>of</strong> R.A. 9184.<br />

In short listing <strong>the</strong> eligible consultants, <strong>the</strong> BAC, shall:<br />

4.1 Draw up <strong>the</strong> short list <strong>of</strong> consultants from those who have been determined as eligible in<br />

accordance with <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> revised IRR. The number <strong>of</strong> short listed consultants,<br />

which shall be determined in <strong>the</strong> pre-<strong>procurement</strong> conference, shall consist <strong>of</strong> three (3) to<br />

seven (7) consultants, with five (5) as <strong>the</strong> preferable number. Should less than <strong>the</strong> required<br />

number apply <strong>for</strong> eligibility and short listing, pass <strong>the</strong> eligibility check, and/or pass <strong>the</strong><br />

minimum score required in <strong>the</strong> short listing, <strong>the</strong> BAC shall consider <strong>the</strong> same (Section<br />

24.5.2 <strong>of</strong> <strong>the</strong> revised IRR).<br />

4.2 Rate each eligible consultant based on <strong>the</strong> following criteria:<br />

a. Applicable experience <strong>of</strong> <strong>the</strong> consultant and members in case <strong>of</strong> joint<br />

ventures, considering both <strong>the</strong> overall experiences <strong>of</strong> <strong>the</strong> firm or, in <strong>the</strong> case <strong>of</strong><br />

new firms, <strong>the</strong> individual experiences <strong>of</strong> <strong>the</strong> principal and key staff, including<br />

<strong>the</strong> times when employed by o<strong>the</strong>r consultants;<br />

b. Qualification <strong>of</strong> personnel who may be assigned to <strong>the</strong> job vis-à- vis<br />

extent and complexity <strong>of</strong> <strong>the</strong> undertaking; and<br />

c. Current workload relative to capacity (Section 24.5.3 <strong>of</strong> <strong>the</strong> revised IRR).<br />

4.3 Recommend <strong>the</strong> short list <strong>of</strong> consultants to <strong>the</strong> HOPE <strong>for</strong> consideration and approval.<br />
