Cash, check, bank draft, letter <strong>of</strong> credit, bank guarantee, surety<br />
bond or a <strong>for</strong>eign government guarantee that serves as a guarantee<br />
that <strong>the</strong> successful bidder shall not default on his <strong>of</strong>fer, and shall<br />
enter into contract with <strong>the</strong> Procuring Entity and furnish <strong>the</strong><br />
per<strong>for</strong>mance security.<br />
A reasonable period determined by <strong>the</strong> head <strong>of</strong> <strong>the</strong> Procuring Entity<br />
concerned, but in no case shall exceed one hundred twenty (120)<br />
calendar days from <strong>the</strong> date <strong>of</strong> <strong>the</strong> opening <strong>of</strong> bids, wherein a Bid<br />
Security is considered valid.<br />
An individual or entity that submits a bid. The term includes anyone<br />
acting on behalf <strong>of</strong> <strong>the</strong> individual or o<strong>the</strong>r entity that submits a bid,<br />
such as agents, employees, and representatives. More specifically,<br />
a contractor, manufacturer, supplier, distributor and/or consultant<br />
competing <strong>for</strong> <strong>the</strong> award <strong>of</strong> a contract in any government<br />
<strong>procurement</strong>. See Eligible bidder, Prospective bidder.<br />
The documents issued by <strong>the</strong> procuring entity as <strong>the</strong> bases <strong>for</strong> bids,<br />
furnishing all in<strong>for</strong>mation necessary <strong>for</strong> a prospective bidder to<br />
prepare a bid <strong>for</strong> <strong>the</strong> infrastructure projects, goods and/or <strong>consulting</strong><br />
<strong>service</strong>s required by <strong>the</strong> procuring entity.<br />
To place on, or as if on, a list <strong>of</strong> persons or organizations that have<br />
incurred disapproval or suspicion or are to be boycotted or<br />
o<strong>the</strong>rwise penalized.<br />
A trade name or product name, which identifies a product as having<br />
been made by a particular manufacturer.<br />
The price <strong>of</strong> a bid, after taking into account minor arithmetical<br />
corrections to consider computational errors, omissions and<br />
discounts, if allowed.<br />

accomplish a fraudulent or deceitful purpose.<br />
Goods, materials and equipment that are repetitively used in <strong>the</strong><br />
day-to-day operations <strong>of</strong> procuring entities in <strong>the</strong> per<strong>for</strong>mance <strong>of</strong><br />
<strong>the</strong>ir functions, which are included in <strong>the</strong> Price List <strong>of</strong> <strong>the</strong><br />
Procurement Service <strong>of</strong> <strong>the</strong> Department <strong>of</strong> Budget and<br />
Management.<br />
Competitiveness A principle in Government <strong>procurement</strong> that allows broad<br />
participation by eligible and qualified suppliers, contractors,<br />
consultants to put <strong>for</strong>ward <strong>of</strong>fers <strong>for</strong> a project.<br />
