Q6: What is <strong>the</strong> <strong>for</strong>mula <strong>for</strong> computing <strong>the</strong> points <strong>for</strong> <strong>the</strong> financial proposal under <strong>the</strong> qualitycost<br />

based evaluation procedure?<br />

A6: The revised IRR does not provide a <strong>for</strong>mula but <strong>the</strong> most widely adopted scoring method<br />

is that <strong>the</strong> financial proposal with <strong>the</strong> lowest cost automatically gets one hundred (100)<br />

points, assuming it is within <strong>the</strong> ABC. The scores <strong>of</strong> <strong>the</strong> o<strong>the</strong>r financial proposals are<br />

determined by pro-rating <strong>the</strong>ir costs with that <strong>of</strong> <strong>the</strong> lowest financial proposal.<br />

Q7: Is <strong>the</strong> replacement <strong>of</strong> key staff to be assigned to <strong>the</strong> project allowed be<strong>for</strong>e awarding <strong>of</strong><br />

contract?<br />

A7: There should be no replacement <strong>of</strong> key personnel be<strong>for</strong>e <strong>the</strong> awarding <strong>of</strong> contract, except<br />

<strong>for</strong> justifiable reason, such as, illness, death, or resignation provided it is duly supported by<br />

relevant certificates, or any delay caused by <strong>the</strong> procuring entity. The procuring entity shall<br />

immediately consider negotiation with <strong>the</strong> next ranked consultant if unjustifiable<br />

replacement <strong>of</strong> personnel by <strong>the</strong> first ranked firm is made. Once <strong>the</strong> contract has been<br />

awarded, no replacement shall be allowed until after fifty percent (50%) <strong>of</strong> <strong>the</strong> personnel‟s<br />

man-months have been served, except <strong>for</strong> justifiable reasons, subject to appropriate<br />

sanctions as prescribed in <strong>the</strong> PBDs (Section 33.3 <strong>of</strong> <strong>the</strong> revised IRR).<br />

Q8: What happens when, at <strong>the</strong> stage <strong>of</strong> negotiation, <strong>the</strong> consultant and <strong>the</strong> Procuring<br />

Entity have irreconcilable positions on certain terms and conditions <strong>of</strong> <strong>the</strong> draft contract?<br />

A8: If <strong>the</strong> consultant and <strong>the</strong> PROCURING ENTITY fail to come to an agreement, <strong>the</strong>n<br />

negotiations shall be deemed unsuccessful and negotiations shall be undertaken with <strong>the</strong><br />

next-in-rank consultant.<br />

Q9: Why is <strong>the</strong> posting <strong>of</strong> bid security and per<strong>for</strong>mance security now required?<br />

A9: Prior to RA 9184 and <strong>the</strong> revised IRR, posting <strong>of</strong> bid and per<strong>for</strong>mance securities was not<br />

required. However, due to <strong>the</strong> number <strong>of</strong> incidents wherein consultancy firms being<br />

considered <strong>for</strong> award have refused to accept <strong>the</strong> award or have simply abandoned <strong>the</strong>ir<br />

consultancy assignments, <strong>the</strong> posting <strong>of</strong> such securities have not been required to serve<br />

as additional protection <strong>for</strong> <strong>the</strong> government and help prevent such incidents from recurring.<br />

Q10: Is <strong>the</strong> privilege granted to provincial bidders to match <strong>the</strong> bid <strong>of</strong> a non-provincial bidder <strong>for</strong><br />

<strong>procurement</strong> <strong>of</strong> infrastructure projects and <strong>of</strong> goods applicable to <strong>procurement</strong> <strong>of</strong><br />

<strong>consulting</strong> <strong>service</strong>s?<br />

A10: No, <strong>the</strong> privilege granted to provincial bidders will not apply to <strong>procurement</strong> <strong>of</strong> <strong>consulting</strong><br />

<strong>service</strong>s, even if <strong>the</strong> selection <strong>of</strong> consultant adopted <strong>the</strong> quality-cost based evaluation<br />

procedure and this has already lapsed last January 2008 (Section 45 <strong>of</strong> <strong>the</strong> revised IRR).<br />
