MANUAL PROCEDURES FOR THE PROCUREMENT OF CONSULTING SERVICES<br />

Where <strong>the</strong> HOPE has made a determination that a Government contract, including<br />

Government contracts required by law to be acted upon and/or approved by <strong>the</strong> President,<br />

involving an amount <strong>of</strong> at least Five Hundred Million Pesos (P 500,000,000.00) falls under<br />

any <strong>of</strong> <strong>the</strong> exceptions from public bidding allowed by law, <strong>the</strong> HOPE shall, be<strong>for</strong>e<br />

proceeding with <strong>the</strong> alternative methods <strong>of</strong> <strong>procurement</strong> provided by law and applicable<br />

rules and regulations, obtain an approval from <strong>the</strong> GPPB that said Government contract<br />

falls within <strong>the</strong> exceptions from public bidding and <strong>the</strong> proposed specific alternative method<br />

<strong>of</strong> <strong>procurement</strong> is <strong>the</strong> appropriate mode <strong>of</strong> <strong>procurement</strong>.<br />

Except <strong>for</strong> Government contracts required by law to be acted upon and/or approved<br />

by <strong>the</strong> President, <strong>the</strong> HOPE, after obtaining <strong>the</strong> <strong>for</strong>egoing requirements, shall have full<br />

contracts <strong>of</strong> his respective agency, entered into through alternative methods <strong>of</strong><br />

<strong>procurement</strong> allowed by law. Provided, that <strong>the</strong> HOPE certifies under oath that <strong>the</strong> contract<br />

has been entered into in faithful compliance with all applicable laws and regulations.<br />

3.8 Per<strong>for</strong>mance Security<br />

A per<strong>for</strong>mance security is a guarantee made by <strong>the</strong> winning bidder to warrant faithful<br />

per<strong>for</strong>mance <strong>of</strong> its obligations under <strong>the</strong> contract in accordance with <strong>the</strong> bidding<br />

documents (Section 39.1 <strong>of</strong> <strong>the</strong> revised IRR). It must be denominated in Philippine<br />

Pesos and posted in favor <strong>of</strong> <strong>the</strong> procuring entity, which shall be <strong>for</strong>feited in <strong>the</strong> latter‟s<br />

favor in <strong>the</strong> event it is established that <strong>the</strong> winning bidder is in default in any <strong>of</strong> its<br />

obligations under <strong>the</strong> contract (Section 39.3 <strong>of</strong> <strong>the</strong> revised IRR). The per<strong>for</strong>mance<br />

security shall remain valid until issuance by <strong>the</strong> procuring entity <strong>of</strong> <strong>the</strong> Certificate <strong>of</strong> Final<br />

Acceptance (Section 39.4 <strong>of</strong> <strong>the</strong> revised IRR).<br />

3.8.1 Schedule <strong>of</strong> posting per<strong>for</strong>mance security<br />

The bidder with <strong>the</strong> HRRB shall post <strong>the</strong> per<strong>for</strong>mance security within a maximum<br />

<strong>of</strong> ten (10) calendar days from <strong>the</strong> winning bidder‟s receipt <strong>of</strong> <strong>the</strong> NOA from <strong>the</strong><br />

Procuring Entity and in no case later than <strong>the</strong> signing <strong>of</strong> <strong>the</strong> contract by both<br />

parties (Section 39.1 <strong>of</strong> <strong>the</strong> revised IRR). It is one <strong>of</strong> <strong>the</strong> requirements to be<br />

submitted by <strong>the</strong> winning bidder, to <strong>for</strong>m part <strong>of</strong> <strong>the</strong> contract (Section 37.2.3 <strong>of</strong><br />

<strong>the</strong> revised IRR).<br />

The bidder shall post a per<strong>for</strong>mance security prior to <strong>the</strong> signing <strong>of</strong> <strong>the</strong> contract<br />

(Section 39.1 <strong>of</strong> <strong>the</strong> revised IRR).<br />

3.8.2 Forms <strong>of</strong> Per<strong>for</strong>mance Security and <strong>the</strong> corresponding amounts<br />

The per<strong>for</strong>mance security shall be in an amount equal to a percentage <strong>of</strong> <strong>the</strong> total<br />

contract price in accordance with <strong>the</strong> following schedule:<br />
