b. The BAC convenes <strong>the</strong> appropriate <strong>of</strong>ficials <strong>for</strong> <strong>the</strong> pre-<strong>procurement</strong> conference, if<br />
deemed necessary.<br />
c. For alternative methods <strong>of</strong> <strong>procurement</strong>, advertisement and posting as prescribed<br />
in Section 21.2.1 <strong>of</strong> <strong>the</strong> revised IRR may be dispensed except in Negotiated<br />
Procurement under Sections 53.1 (two-failed biddings) and 53.9 (small value<br />
<strong>procurement</strong>) wherein <strong>the</strong> BAC, through <strong>the</strong> Secretariat, shall post <strong>for</strong> in<strong>for</strong>mation<br />
purposes <strong>the</strong> <strong>procurement</strong> opportunity <strong>for</strong> in:<br />
i. PhilGEPS;<br />
ii.<br />
iii.<br />
Website <strong>of</strong> <strong>the</strong> Procuring Entity, if available; and<br />
Any conspicuous place in <strong>the</strong> premises <strong>of</strong> <strong>the</strong> Procuring Entity.<br />
d. The posting shall be done <strong>for</strong> a maximum period <strong>of</strong> seven (7) calendar days prior<br />
to bid opening (Section 54.2 <strong>of</strong> <strong>the</strong> revised IRR).<br />
e. The contract awarded must be posted in <strong>the</strong> a<strong>for</strong>ementioned websites and at any<br />
conspicuous place reserved <strong>for</strong> this purpose in <strong>the</strong> premises <strong>of</strong> <strong>the</strong> procuring entity<br />
(Section 54.3 <strong>of</strong> <strong>the</strong> revised IRR).<br />
f. If <strong>the</strong> <strong>procurement</strong> is being negotiated in case <strong>of</strong> imminent danger to life or<br />
property, <strong>the</strong> BAC, through <strong>the</strong> BAC Secretariat, may negotiate with any supplier,<br />
contractor or consultant who is legally, technically and financially capable. Only<br />
notices <strong>of</strong> awards shall be posted.<br />
3.2 PROCEDURE IN THE CONDUCT OF TWO-FAILED BIDDING UNDER SECTION 53.1<br />
OF THE REVISED IRR<br />
Where <strong>the</strong>re has been failure <strong>of</strong> public bidding <strong>for</strong> <strong>the</strong> second time as provided in Section<br />
35 <strong>of</strong> <strong>the</strong> RA 9184 and <strong>the</strong> revised IRR, <strong>the</strong> following process must be per<strong>for</strong>med:<br />
a. After conduct <strong>of</strong> <strong>the</strong> mandatory review <strong>of</strong> <strong>the</strong> terms, conditions, specifications, and<br />
cost estimates, as prescribed in Section 35 <strong>of</strong> <strong>the</strong> revised IRR, <strong>the</strong> BAC shall<br />
revise and agree on <strong>the</strong> minimum technical specifications, and if necessary, adjust<br />
<strong>the</strong> ABC, subject to <strong>the</strong> required approvals. However, <strong>the</strong> ABC cannot be<br />
increased by more than twenty percent (20%) <strong>of</strong> <strong>the</strong> ABC <strong>for</strong> <strong>the</strong> last failed bidding<br />
(Section 53.1.1 <strong>of</strong> <strong>the</strong> revised IRR).<br />
b. The BAC shall invite and engage in negotiations with a sufficient number <strong>of</strong><br />
suppliers, contractors or consultants to ensure effective competition (Section<br />
53.1.2 <strong>of</strong> <strong>the</strong> revised IRR).<br />
All Procuring Entities shall maintain a registry <strong>of</strong> suppliers, contractors, and<br />
consultants as basis <strong>for</strong> drawing up <strong>the</strong> short list and/or selecting <strong>the</strong> suppliers,<br />
contractors, and consultants <strong>for</strong> negotiations.<br />
