Deep Ellum TIF District FY 2011<br />

Annual Report<br />

submitted by the Deep Ellum TIF District's Board <strong>of</strong> Directors, and authorizing the<br />

<strong>City</strong> Manager to submit the annual report to the chief executive <strong>of</strong>ficer <strong>of</strong> each<br />

taxing jurisdiction that levies taxes on real property in the District, and to the<br />

Attorney General <strong>of</strong> Texas, and the State Comptroller, as required by state law.<br />

• On March 25, 2011 the <strong>City</strong> Council, by Resolution 1-1308, authorized a<br />

Supplemental Agreement No. 2 to the pr<strong>of</strong>essional services contract with<br />

TranSystems Corporation to provide additional engineering design and surveying<br />

services to add the Deep Ellum Streetscape Project to Streetscape Group 06-<br />

3010 - Not to exceed $694,859, from $412,171 to $1,107,030 - Financing: 2003<br />

Bond Funds ($301,088), 2006 Bond Funds ($293,791) and Water Utilities Capital<br />

Improvement Funds ($99,980).<br />

• On March 25, 2011 the <strong>City</strong> Council, by Resolution 11-1358 and Ordinance<br />

Number 28206, held a public hearing to receive comments regarding an<br />

ordinance granting the renewal <strong>of</strong> Specific Use Permit No. 1757 for a Bar,<br />

lounge, or tavern and an Inside commercial amusement for a live music venue<br />

on property within the Tract A portion <strong>of</strong> Planned Development District No. 269,<br />

the Deep Ellum/Near East Side Special Purpose District, on the northeast corner<br />

<strong>of</strong> Elm Street and July Alley and authorized the ordinance. Recommendation <strong>of</strong><br />

Staff and CPC: Approval for a three-year period, subject to conditions Z101-<br />

187(RB).<br />

• On June 22, 2011 the <strong>City</strong> Council, by Resolution 11-1753, authorized an<br />

amendment to the Project Plan and Reinvestment Zone Financing Plan (“Plan”)<br />

for Tax Increment Financing Reinvestment Zone Number Twelve, <strong>City</strong> <strong>of</strong> <strong>Dallas</strong>,<br />

Texas (“Deep Ellum TIF District”) in accordance with the Tax Increment<br />

Financing Act, as amended (V.T.C.A. Tax Code, Chapter 311, hereafter the<br />

“Act”), to: (1) prioritize the redevelopment <strong>of</strong> the <strong>City</strong> Lights site’ as a goal <strong>of</strong> the<br />

Plan; (2) expand the <strong>City</strong> Lights Improvements budget category to include <strong>City</strong><br />

Lights Area Improvements; (3) add Exhibits G-1 and G-2 to the Plan to illustrate<br />

redevelopment plans for the <strong>City</strong> Lights site; and (4) authorize related changes to<br />

the Plan consistent with the directed sale <strong>of</strong> city property for the <strong>City</strong> Lights<br />

project - Financing: No cost consideration to the <strong>City</strong>.<br />

• On June 22, 2011 the <strong>City</strong> Council, by Resolution 11-1760, authorized a<br />

resolution authorizing the sale <strong>of</strong> approximately 83,478 square feet <strong>of</strong> unneeded<br />

and unwanted <strong>City</strong>-owned land located near the intersection <strong>of</strong> Live Oak and<br />

Cantegral streets to Minerva Partners, Ltd., a Texas Limited Partnership, for the<br />

development <strong>of</strong> a high density mixed use project in accordance with the Deep<br />

Ellum TIF District Project Plan - Revenue: $2,170,000.<br />

• On June 22, 2011 the <strong>City</strong> Council, by Resolution 11-1792 and Ordinance<br />

Number 28278, held a public hearing to receive comments on a proposed<br />

municipal setting designation to prohibit the use <strong>of</strong> groundwater as potable water<br />

beneath property owned by Westdale Properties America I, Ltd., Westdale<br />
