Deep Ellum TIF District FY 2011<br />

Annual Report<br />

Properties, Westdale Deep Ellum L<strong>of</strong>ts, and <strong>Dallas</strong> Area Rapid Transit located<br />

near the intersection <strong>of</strong> Main Street and Trunk Avenue and adjacent street rights<strong>of</strong>-way,<br />

and an ordinance authorizing support <strong>of</strong> the issuance <strong>of</strong> a municipal<br />

setting designation to Westdale Asset Management, Ltd. by the Texas<br />

Commission on Environmental Quality and prohibiting the use <strong>of</strong> groundwater<br />

beneath the designated property as potable water - Financing: No cost<br />

consideration to the <strong>City</strong>.<br />

• On August 10, 2011 the <strong>City</strong> Council, by Resolution 11-2037 and Ordinance<br />

Number 28299, held a public hearing to receive comments regarding an<br />

application for an ordinance granting the renewal <strong>of</strong> Specific Use Permit No.<br />

1696 for a bar, lounge, or tavern on property zoned Planned Development<br />

District No. 269, the Deep Ellum/Near East Side Special Purpose District on the<br />

south side <strong>of</strong> Elm Street, east <strong>of</strong> Crowdus Street and authorized the ordinance.<br />

Recommendation <strong>of</strong> Staff and CPC: Approval for a one-year period, subject to<br />

conditions Z101-123(WE).<br />

• On August 10, 2011 the <strong>City</strong> Council, by Resolution 11-2038 and Ordinance<br />

Number 28300, held a public hearing to receive comments regarding an<br />

application for an ordinance granting the renewal <strong>of</strong> Specific Use Permit No.<br />

1767 for a bar, lounge, or tavern on property within the Tract A portion <strong>of</strong><br />

Planned Development District No. 269, the Deep Ellum/Near East Side Special<br />

Purpose District, on the north line <strong>of</strong> Commerce Street, east <strong>of</strong> Good Latimer<br />

Expressway Recommendation <strong>of</strong> Staff and CPC: Approval for a three-year<br />

period, subject to conditions Z101-257(RB).<br />

In an ongoing effort for Deep Ellum to eliminate undesirable bar, lounges, and<br />

taverns, such establishments were required to obtain a Specific Use Permit (SUP)<br />

from the <strong>City</strong> <strong>of</strong> <strong>Dallas</strong> to comply with new zoning regulations. Three entertainment<br />

venues obtained SUPs during the fiscal year. They include Double Wide, La<br />

Grange, and the Black Swan Saloon.<br />

Pending TIF Items<br />

The pending items for the Deep Ellum TIF District include:<br />

• The <strong>City</strong> Council consideration <strong>of</strong> the FY 2011 Annual Report regarding the<br />

development and financial status <strong>of</strong> the District.<br />

• Consideration <strong>of</strong> development incentives for <strong>City</strong> Lights project.<br />

• Update By-Laws for Deep Ellum TIF District to reflect changes in Board<br />

composition and design review.<br />
