COUNCIL CHAMBER<br />

February 22, 2012<br />

WHEREAS, on December 15, 2011, three proposals were received and opened for<br />

improvements at L.B. Houston Golf Course and Clubhouse including erosion control<br />

and drainage, greens contouring and replacement, soil preparation, fairway sculpting<br />

and grassing, landscaping; and upgrade <strong>of</strong> the existing golf course clubhouse at L.B.<br />

Houston Golf Course located at 11223 Luna Road; and<br />

WHEREAS, it has been determined that acceptance <strong>of</strong> the proposal <strong>of</strong>fer from<br />

Rogers-O'Brien Construction Company, Ltd. for a Guaranteed Maximum Price in the<br />

amount <strong>of</strong> $4,770,259 is the best value for the <strong>City</strong> <strong>of</strong> <strong>Dallas</strong>; and<br />

WHEREAS, this will authorize a construction manager at risk contract with<br />

Rogers-O'Brien Construction Company, Ltd., for improvements at Elm Fork Gun Range;<br />

tennis court renovations at L.B. Houston Tennis Center; renovation <strong>of</strong> the L.B. Houston<br />

Golf Course including erosion control and drainage, greens contouring and<br />

replacement, soil preparation, fairway sculpting and grassing, landscaping; and upgrade<br />

<strong>of</strong> the existing golf course clubhouse at L.B. Houston Golf Course, in an amount not to<br />

exceed $4,770,259; and<br />

WHEREAS, the <strong>City</strong> Charter provides for the Park and Recreation Board to grant<br />

contracts and agreements within park facilities with such terms and conditions as it shall<br />

deem proper; and<br />

WHEREAS, the Park and Recreation Board has developed a golf pro shop<br />

management plan which provides for the operation <strong>of</strong> the golf pro shops at Cedar Crest,<br />

L. B. Houston, Stevens Park, Tenison Park and Grover C. Keeton Golf Courses through<br />

pr<strong>of</strong>essional managers as independent contractors; and<br />

WHEREAS, the <strong>City</strong> Charter requires that the <strong>City</strong> Council approve any contract which<br />

exceeds one year in duration; and<br />

WHEREAS, on June 11, 2008, Resolution No. 08-1655 authorized a management<br />

agreement for the operation <strong>of</strong> the golf pro shop that provides for full service golf<br />

facilities at Cedar Crest, L.B. Houston, Stevens Park, Tenison Park and Grover C.<br />

Keeton to the citizens including merchandise, golf carts, club repairs, club rentals, food<br />

and drink, beer, driving range, lessons, and building reservations through pr<strong>of</strong>essional<br />

managers as independent contractors; and<br />

WHEREAS, this will authorize an amendment to the management agreement contract<br />

with Mickey Ray Piersall Golf Shop to define roles, responsibilities, compensation and<br />

reimbursement for pr<strong>of</strong>essional services performed and costs incurred during the<br />

premises closure including security, insurance, staffing to close and re-open the<br />

restaurant and pro shop and increased unemployment taxes as a result <strong>of</strong> the closure <strong>of</strong><br />

L.B. Houston Golf Course for renovation, in an amount not to exceed $205,275.
