the current traffic management plan is sufficient.<br />

(A) If the director determines that the current traffic management plan is<br />

sufficient, the director shall notify the applicant in writing.<br />

(B) If the director determines that the current traffic management plan results<br />

in traffic hazards or traffic congestion, the director shall require the Property owner to submit an amended<br />

traffic management plan. If the Property owner fails to submit an amended traffic management plan<br />

within 30 days, the director shall notify the city plan commission.<br />

(d)<br />

Amendment process.<br />

(1) A traffic management plan may be amended using the minor plan amendment fee<br />

and public hearing process in Section 51A-1.105(k)(3).<br />

(2) The city plan commission shall authorize changes in a traffic management plan if<br />

the proposed amendments improve queuing or traffic circulation; eliminate traffic hazards; or decrease<br />

traffic congestion.<br />

SEC. 51P- .111. WESTMORELAND ROAD PEDESTRIAN CROSSING.<br />

(a)<br />

In general.<br />

(1) In general. The property consists <strong>of</strong> three tracts <strong>of</strong> land; Tracts 1 and 2 located on<br />

the west line <strong>of</strong> Westmoreland Road, and Tract 3 located on the east line <strong>of</strong> Westmoreland Road. This<br />

district permits Tracts 1, 2, and 3 to be considered as one lot for <strong>of</strong>f-street parking purposes and as a<br />

result, will require pedestrians to routinely cross Westmoreland Road, a six lane divided thoroughfare.<br />

(b)<br />

Pedestrian crossing study.<br />

(1) The Property owner or operator shall prepare an analysis <strong>of</strong> the impact <strong>of</strong><br />

pedestrian crossings between the three tracts <strong>of</strong> the Property, which are separated by Westmoreland Road,<br />

to determine pedestrian safety is not compromised. The initial pedestrian crossing study must be<br />

submitted to the director by November 1, 2013. After the initial pedestrian crossing study, the Property<br />

owner or operator shall submit updates <strong>of</strong> the pedestrian crossing study to the director by November 1 <strong>of</strong><br />

each subsequent two-year period.<br />

(2) The pedestrian crossing study must be in writing, performed by a licensed<br />

engineer, based on a minimum <strong>of</strong> four samples taken on different days (two <strong>of</strong> which would include a<br />

Sunday and a holiday in which the Property owner <strong>of</strong>fers a significant activity in which a large gathering<br />

is anticipated), and must contain an analysis <strong>of</strong> the following:<br />

(A)<br />

(B)<br />

(C)<br />

duration <strong>of</strong> pedestrian crossings;<br />

pedestrian counts for duration period;<br />

how pedestrians are crossing between tracts;<br />

(3) Within 30 days after submission <strong>of</strong> a pedestrian crossing study update, the<br />

director shall determine if the current pedestrian crossing study is sufficient.<br />

(A) If the director determines that the current pedestrian crossing study is<br />

sufficient, the director shall notify the applicant in writing.<br />
