Authorize the release <strong>of</strong> lien on a secured, no interest, forgivable loan with Legacy<br />

Counseling Center, Inc., for non-substantial rehabilitation at Legacy Founders Cottage<br />

located at 828 South Tyler Street in the amount <strong>of</strong> $6,734 - Financing: No cost<br />

consideration to the <strong>City</strong><br />

BACKGROUND<br />

<strong>City</strong> Council authorization is required to secure or release a lien on real property (<strong>Dallas</strong><br />

<strong>City</strong> Code Section 2-11.1 - 2.11.2).<br />

On November 12, 2007, the <strong>City</strong> Council approved Resolution No. 07-3300, which<br />

authorized the execution <strong>of</strong> a secured, no-interest forgivable loan agreement with<br />

Legacy Counseling Center, Inc. (Legacy) for non-substantial rehabilitation at the Legacy<br />

Founders Cottage located at 828 South Tyler Street, <strong>Dallas</strong>, <strong>Dallas</strong> County, Texas<br />

(75208). The rehabilitation activities were funded through FY2007-08 Housing<br />

Opportunities for Persons with AIDS (HOPWA) grant funds.<br />

The agency provides facility based housing assistance and hospice/respite care to<br />

critically ill persons living with HIV/AIDS, at the Legacy Founders Cottage. The agency<br />

also provides mental health and substance abuse services for persons living with<br />

HIV/AIDS at its Oak Lawn location.<br />

Any building or structure assisted under HOPWA for non-substantial rehabilitation must<br />

be maintained as a facility to provide housing or assistance for persons living with<br />

HIV/AIDS for a period <strong>of</strong> not less than three (3) years. Legacy Counseling Center, Inc.<br />

has provided housing and assistance for persons living with HIV/AIDS at Legacy<br />

Founders Cottage for the time period required by the U.S. Department <strong>of</strong> Housing and<br />

Urban Development.
