Authorize an amendment to the development agreement with the Kessler Theater, LLC,<br />

previously approved on November 9, 2009, by Resolution No. 09-2762-01, in Tax<br />

Increment Financing Reinvestment Zone Number Sixteen (Davis Garden TIF District) to<br />

extend the deadlines related to the completion <strong>of</strong> the Kessler Theater project to July 1,<br />

2012 - Financing: No cost consideration to the <strong>City</strong><br />

BACKGROUND<br />

On November 9, 2009, <strong>City</strong> Council approved the Kessler Theater, LLC’s request for<br />

$199,643 in TIF reimbursement for the Kessler Theater’s renovation. The project will<br />

include: (1) environmental remediation, demolition, and façade improvements at 1214<br />

West Davis Street. The environmental remediation and demolition activities will consist<br />

<strong>of</strong> the assessment and removal <strong>of</strong> asbestos hazards. The façade improvements include<br />

repairs to the theater’s façade and the replacement <strong>of</strong> its awnings, blade sign, doors,<br />

marquee, and poster cases; and (2) infrastructure improvements along West Davis<br />

Street between North Clinton Avenue and North Winnetka Avenue, and infrastructure<br />

improvements along North Clinton Avenue between West Davis and West 7 th<br />

Streets.<br />

The infrastructure improvements will consist <strong>of</strong> converting on-street parking along West<br />

Davis Street and the sidewalk along North Clinton Avenue to expand the existing<br />

pedestrian area adjacent to the theater. The expanded pedestrian area will<br />

accommodate the removal and replacement <strong>of</strong> the existing sidewalks, the planting <strong>of</strong><br />

native plants and trees, and the addition <strong>of</strong> pedestrian lighting, outdoor seating (i.e.<br />

benches, tables, and chairs) and bike racks. The new sidewalks shall be measured from<br />

the back <strong>of</strong> the curb and include a 3-foot wide landscaping/pedestrian lighting zone<br />

adjacent to the curb and a 7-foot wide pedestrian zone.
