COUNCIL CHAMBER<br />

February 22, 2012<br />

WHEREAS, on December 9, 1998, the <strong>City</strong> Council <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Dallas</strong> approved<br />

Resolution No. 98-3515, authorizing the <strong>City</strong> Manager to execute a lease agreement<br />

dated December 21, 1998, (the “Lease”) with <strong>Dallas</strong> Children’s Advocacy Center as<br />

Lessor (“Landlord”) and <strong>City</strong> <strong>of</strong> <strong>Dallas</strong>, as Lessee (“<strong>City</strong>”) for approximately 3,731<br />

square feet <strong>of</strong> <strong>of</strong>fice space and five (5) parking spaces located at 3611 Swiss Avenue;<br />

<strong>Dallas</strong>, <strong>Dallas</strong> County, Texas to be used by the <strong>Dallas</strong> Police Department’s Youth and<br />

Family Crimes Division; and<br />

WHEREAS, the Lease was amended by the First Amendment to the Lease Agreement<br />

dated January 22, 2000, extending the term <strong>of</strong> the Lease to December 31, 2005; and<br />

WHEREAS, the Lease was amended by the Second Amendment to the Lease<br />

Agreement dated November 7, 2005, extending the term <strong>of</strong> the Lease to December 31,<br />

2010; and<br />

WHEREAS, the Lease was amended by the Third Amendment to the Lease Agreement<br />

dated August 19, 2010, extending the term <strong>of</strong> the Lease to December 31, 2011; and<br />

WHEREAS, the Lease, as amended, expires by its own terms on December 31, 2011;<br />

and<br />

WHEREAS, the parties desire to extend the lease term for one (1) year, at the same<br />

rental rate;<br />

NOW, THEREFORE,<br />

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DALLAS:<br />

SECTION 1. That the <strong>City</strong> Manager, upon approval as to form by the <strong>City</strong> Attorney, be<br />

and is hereby authorized to execute a Fourth Amendment to the Lease Agreement<br />

between <strong>Dallas</strong> Children’s Advocacy, a nonpr<strong>of</strong>it corporation and the <strong>City</strong> <strong>of</strong> <strong>Dallas</strong>.<br />

SECTION 2. That the special terms and conditions <strong>of</strong> the Fourth Amendment to the<br />

Lease Agreement are:<br />

(a) The term <strong>of</strong> the Lease is extended for one (1) year, effective January 1, 2012<br />

and ending December 31, 2012, provided however, that <strong>City</strong> and Landlord<br />

retain the right to terminate the Lease as provided elsewhere therein.<br />

(b)<br />

Base Rental payments shall be as follows (subject to annual appropriations):<br />

January 1, 2012 – December 31, 2012<br />

$4,104.10 per month
