“To be the leading, people centered municipality excelling in economic growth, development and governance”1.3 LEGISLATIVE CONTEXTCONSTITUTION OF THE REPUBLIC OF SOUTH AFRICA,The Constitution of the Republic of South Africa, 1996 stipulates that the local sphere of government consists ofmunicipalities which were established for the whole of the territory of South Africa – the so-called wall-to-wallmunicipalities. The objects of local government are set out in Section 152 of the Constitution. Accordingly the objectsare –a) to provide democratic and accountable government for local communities;b) to ensure the provision of services to communities in a sustainable manner;c) to promote social and economic development;d) to promote a safe and healthy environment; ande) to encourage the involvement of communities and community organisations in the matters of local government.The Constitution commits government to take reasonable measures, within its available resources, to ensure that allSouth Africans have access to adequate housing, health care, education, food, water and social security.MUNICIPAL SYSTEMS ACT (ACT 32 OF 2000)The compilation of Integrated Development Plans by municipalities is regulated in terms of the Municipal Systems Act(Act 32 of 2000). Section 25 of the Municipal Systems Act (Act 32 of 2000) stipulates that: “Each municipal council must,within a prescribed period after the start of its elected term, adopt a single, inclusive and strategic plan for thedevelopment of the municipality which –(a) links, integrates and co-ordinates plans and takes into account proposals for the development of the municipality;(b) aligns the resources and capacity of the municipality with the implementation of the plan;(c) forms the policy framework and general basis on which annual budgets must be based;(d) complies with the provisions of this Chapter; and(e) is compatible with national and provincial development plans and planning requirements binding on the municipalityin terms of legislation”.As far as the status of an Integrated Development Plan is concerned, Section 35 states that an Integrated DevelopmentPlan adopted by the Council of a Municipality –“(a) is the principal strategic planning instrument which guides and informs all planning and development, and alldecisions with regard to planning, management and development, in the municipality;(b) binds the municipality in the exercise of its executive authority, except to the extent of any inconsistency between amunicipality’s integrated development plan and national or provincial legislation, in which case such legislation prevails;and(c) binds all other persons to the extent that those parts of the integrated development plan that impose duties or affectthe rights of those persons have been passed as a by-law”.Section 36 furthermore stipulates that –“A municipality must give effect to its integrated development plan and conduct its affairs in a manner which isconsistent with its Integrated Development Plan”. However, in terms of section 34 of the Municipal Systems Act, amunicipal council “must review its Integrated Development Plan annually .....”, and based on the outcome of the reviewprocess it “may amend its Integrated Development Plan in accordance with a prescribed process”.The MSA thus places a legislative duty on municipalities to adopt a single, inclusive and strategic plan (IntegratedDevelopment) for the development of the municipality which links; integrates an co-ordinates plans and takes intoaccount proposals for the development of the municipality; aligns the resources and capacity of the municipality withthe implementation of the plan; and forms the policy framework and general basis on which annual budgets must bebased.17 | P a g e - D r a f t i n t e g r a t e d D e v e l o p m e n t P l a n 2 0 1 3 / 2 0 1 4
“To be the leading, people centered municipality excelling in economic growth, development and governance”INTER–GOVERMENTAL PLANNINGSection 41(1) of the Constitution contains the principles of co-operative government and inter-governmental relations.Accordingly Section 41(1) determines that; all spheres of government and all organs of state within each sphere must -a. preserve the peace, national unity and the indivisibility of the Republic;b. secure the well-being of the people of the Republic;c. provide effective, transparent, accountable and coherent government for the Republic as a whole;d. be loyal to the Constitution, the Republic and its people;e. respect the constitutional status, institutions, powers and functions of government in the other spheres;f. not assume any power or function except those conferred on them in terms of the Constitution;g. exercise their powers and perform their functions in a manner that does not encroach on the geographical,functional or institutional integrity of government in another sphere; andh. co-operate with one another in mutual trust and good faith by –i. fostering friendly relations;ii. assisting and supporting one another;iii. informing one another of, and consulting one another on, matters of common interest;iv. coordinating their actions and legislation with one another;v. adhering to agreed procedures; andvi. Avoiding legal proceedings against one another Inter-governmental relations‟ means the relationships betweennational, provincial and local government.
