The technique implies the way in which the installation isdesigned, built, maintained, operated <strong>and</strong> decommissioned or closed, including thetechnology that is used. Available means techniques that have been developed on a scalewhich allows the implementation in the relevant industry sector, under economically <strong>and</strong>technically acceptable conditions, including costs <strong>and</strong> benefits, as long as they arereasonably accessible to the operator (physical or legal entity that operates theinstallation, controls it or that is authorised to make economic decisions in the field <strong>of</strong>technical functioning <strong>of</strong> the installation <strong>and</strong> in the name <strong>of</strong> which the integrated permit isissued). “The best” means the most effective in achieving a high general level <strong>of</strong>protection <strong>of</strong> the environment as a whole. The original European Directive (96/ 61/ EC(1996)) also lists the industrial branches that it refers to, which include the foodprocessingindustry processing raw materials <strong>of</strong> plant origin with the daily capacityexceeding 300 tons <strong>of</strong> final products. [18]The Council Directive 91/676/EEC on protection <strong>of</strong> waters against pollution with nitritescoming from agricultural sources requires the states to develop st<strong>and</strong>ards for healthyagriculture, which would also include training <strong>and</strong> information. [2]The Directive 86/278/EEC on environmental protection, <strong>and</strong> soil in particular in thecae<strong>of</strong> use <strong>of</strong> secondary fertilisers in agriculture – use <strong>of</strong> mud in agriculture aimed atprevention <strong>of</strong> pollution <strong>of</strong> soil, vegetation, people <strong>and</strong> animals. The list <strong>of</strong> the mainpolluting substances for which it is necessary to set the emission values also includes thesubstances that pollute waters causing undesirable impact on the oxygen balance that canbe measured through HPK, BPK5 <strong>and</strong> similar parameters <strong>and</strong> that can also encompassthe oils <strong>of</strong> plant origin. [3]The Guidelines <strong>of</strong> the Integrated Pollution Prevention <strong>and</strong> Control Bureau (IPPC) arelaid down through BREF – BAT reference documents (2004) that refer to the bestavailable techniques in certain industries – production <strong>of</strong> food, drinks <strong>and</strong> milk,production <strong>of</strong> plant oils etc. [14]In May 2009, the Parliament <strong>of</strong> Serbia passed some additional laws in the field <strong>of</strong>ecology: Law on Protection Against Non-ionising Radiation <strong>and</strong> Law on Chemicals,with which the national legislation in that field is harmonised with the EU legislation.The Parliament also passed Law on Biocide Products, which should set a safer system <strong>of</strong>placing <strong>of</strong> those products on the market <strong>and</strong> their use with an adequate information forconsumers on methods <strong>of</strong> their use [16], as well as the Law on changes <strong>and</strong> amendments<strong>of</strong> the Law on Environmental Impact Assessment, which should shorten the period <strong>of</strong>obtaining <strong>of</strong> permits for environmental impact assessment studies. The Law alsoprovides the possibility for the competent authority to set the minimum environmentalprotection measures based on the decision on liberation from the obligation to elaboratethe environmental impact assessment study. [24]The Law on Protection Against Non-ionising Radiation anticipates decentralisation <strong>and</strong>more efficient implementation <strong>of</strong> measures <strong>and</strong> supervision in use <strong>of</strong> sources <strong>of</strong> nonionisingradiation. The enacted Law shall enable more efficient implementation <strong>of</strong>measures <strong>of</strong> protection <strong>of</strong> health <strong>of</strong> people <strong>and</strong> protection <strong>of</strong> the environment againstdetrimental effect <strong>of</strong> such radiation. It also defines special sensitive cases such asschools, nurseries, <strong>and</strong> health care institutions where it will not be possible to installsources <strong>of</strong> non-ionising radiation such as antenna systems <strong>of</strong> telecommunication devices.[21]339
