AMENDMENT NO. 05 TO AGREEMENT BETWEENOWNER AND CONSTRUCTION MANAGERPursuant to Paragraph 2.2 of the Agreement, dated April 28, 2009 between Seminole County SchoolBoard (Owner) and Welbro Building Corporation (Construction Manager) for continuingconstruction management at risk services, this amendment includes the work as follows: New 8” fireline including one new fire hydrant and one relocated fire hydrant at Woodlands Elementary School.The Owner and Construction Manager establish a Guaranteed Maximum Price and Contract Time forthe Work as set forth below.ARTICLE 1GUARANTEED MAXIMUM PRICEThe Construction Manager’s Guaranteed Maximum Price for the work, including the estimated Costof the Work, preconstruction services, the Construction Manager’s Fee and allowances totals$111,545.00 (One Hundred Eleven Thousand Five Hundred Forty Five Dollars And No/ Cents).This price is for the performance of the work in accordance with:Exhibit A: GMP proposal prepared by Welbro Building Corporation dated May 9,2011.ARTICLE IICONTRACT TIMEThe date of Substantial Completion established by this Amendment is as follows: August 5 th 2011.Liquidated damages are set at $100.00 (0ne Hundred and no/100 dollars) per calendar day for failureto substantially complete the project as stated herein.
