Note:Florida Statute 1003.32(4) authorizes teachers to remove a student who is unruly, disr<strong>up</strong>tive, or abusive,or who repeatedly <strong>in</strong>terferes with the teacher’s ability to communicate with the class or the ability of thestudent’s classmates to learn <strong>in</strong> accordance with the provisions of 1003.32(5) & (6).REASONABLE FORCEFlorida Statute 1003.32(1)(J) authorizes teachers and other <strong>in</strong>structional personnel to use reasonable force toprotect himself/herself or others from <strong>in</strong>jury. The Department of Education has def<strong>in</strong>ed reasonable force as,“appropriate professional conduct <strong>in</strong>clud<strong>in</strong>g physical force as necessary to ma<strong>in</strong>ta<strong>in</strong> a safe and orderlyenvironment.” The Department of Education has also clarified that school personnel do have the right and theauthority to protect aga<strong>in</strong>st:1. conditions harmful to learn<strong>in</strong>g;2. conditions harmful to student’s physical and mental health;3. conditions harmful to safety; or4. conditions harmful, caus<strong>in</strong>g <strong>in</strong>jury to self, school personnel, and others.Note:Florida Statute 1006.11(2) further provides that a pr<strong>in</strong>cipal, teacher, other staff members, or bus drivershall <strong>not</strong> be civilly or crim<strong>in</strong>ally liable for any action carried out <strong>in</strong> conformity with School Board rulesregard<strong>in</strong>g the control, discipl<strong>in</strong>e, suspension, and expulsion of students, except <strong>in</strong> the case of excessiveforce or cruel and unusual punishment.STUDENT RESPONSIBILITIESThe follow<strong>in</strong>g declaration outl<strong>in</strong>es the fundamental responsibilities of all students who attend Sem<strong>in</strong>ole <strong>County</strong>Public <strong>Schools</strong>:Responsible Students Make the DifferenceStudents are required to:1. attend school regularly;2. treat others with respect;3. treat school property and the property of others with respect;4. respect the privacy of others;5. have <strong>in</strong> their possession only those items allowed by law and/or School Board rules orpolicies;6. listen courteously to the op<strong>in</strong>ions and po<strong>in</strong>ts of view of others;7. come to class with all necessary materials and be prepared to learn;8. take advantage of their learn<strong>in</strong>g opportunities;9. report hazardous or dangerous situations to an adult <strong>in</strong> authority;10. report threats to do harm to an adult <strong>in</strong> authority, and11. submit orig<strong>in</strong>al work.Note:The "Speak-Out" program provides three 24 hour monitored services that allows students, parents, orcommunity members to anonymously report concerns regard<strong>in</strong>g drugs, weapons, bully<strong>in</strong>g, harassment,violence, abuse, suicide, or other problems by call<strong>in</strong>g (1-800-423-8477), text<strong>in</strong>g (274637) or report<strong>in</strong>gat e-mail (www.speakouthotl<strong>in</strong>e.org) anonymously to report concerns regard<strong>in</strong>g drugs, weapons,violence, abuse, suicide, or other problems. Speak-OutIt has contributed to the district's ability to beproactive <strong>in</strong> respond<strong>in</strong>g to various situations before they escalate to the crisis level.STUDENT RIGHTS3Page 536
