Note:Self Defense – a student has the right to protect self from un<strong>in</strong>vited physical harm or <strong>in</strong>jury. A validclaim of self defense requires the danger of bodily harm to have been imm<strong>in</strong>ent, that the student wasunable to decl<strong>in</strong>e or escape the conflict, that the student did <strong>not</strong> say or do anyth<strong>in</strong>g for the purpose ofprovok<strong>in</strong>g a<strong>not</strong>her student, and that the student used reasonable force and restra<strong>in</strong>t <strong>in</strong> protect<strong>in</strong>ghim/herself. Retaliation is <strong>not</strong> self-defense.Firearms Violation - possess<strong>in</strong>g, us<strong>in</strong>g, sell<strong>in</strong>g, stor<strong>in</strong>g, distribut<strong>in</strong>g, or detonat<strong>in</strong>g any weapon which isdesigned to, or may be readily converted to, expel a projectile by the action of an explosive; the frame or receiverof any such weapon, any firearm muffler or firearm silencer, or any destructive device. Includes firearms of anyk<strong>in</strong>d (operable or <strong>in</strong>operable; loaded or unloaded), <strong>in</strong>clud<strong>in</strong>g, but <strong>not</strong> limited to, hand guns, zip guns, pistols,rifles, shot guns, or flare guns.Forgery - mak<strong>in</strong>g a false or mislead<strong>in</strong>g written communication to a school staff member with either the <strong>in</strong>tent todeceive or under circumstances which would reasonably be calculated to deceive the staff member, or produc<strong>in</strong>gor possess<strong>in</strong>g any false document, item, or record represented to be an authentic school document, item, or record.Gambl<strong>in</strong>g - any participation <strong>in</strong> games or activities of chance for money or items of value.Gang-Related Activity - engag<strong>in</strong>g <strong>in</strong> any verbal, written, or physical act which is associated with becom<strong>in</strong>g amember of a gang, be<strong>in</strong>g a member of a gang, or participat<strong>in</strong>g <strong>in</strong> gang identified rituals or behaviors on a schoolcampus or at a school sponsored program or activity.Harassment (S) – threaten<strong>in</strong>g, <strong>in</strong>sult<strong>in</strong>g or dehumaniz<strong>in</strong>g gesture plac<strong>in</strong>g a<strong>not</strong>her <strong>in</strong> reasonable fear of harm tohis/her person or damage to his/her property; substantially <strong>in</strong>terfer<strong>in</strong>g with a student’s educational performance,opportunities, or benefits; substantially disr<strong>up</strong>t<strong>in</strong>g the orderly operation of a school or any school or school districtactivity (refer to bully<strong>in</strong>g/harassment policy).Hate Crime – an act or acts that evidence prejudice based on race, religion, ethnicity, color ancestry, sexualorientation, or national orig<strong>in</strong>.Haz<strong>in</strong>g – participat<strong>in</strong>g <strong>in</strong> any act that humiliates, demeans, or endangers a person <strong>in</strong> order for an <strong>in</strong>dividual tojo<strong>in</strong>, be <strong>in</strong>itiated <strong>in</strong>to, or become affiliated with a gro<strong>up</strong> organization, team, club, or a school sponsored programor activity.Horseplay - engag<strong>in</strong>g <strong>in</strong> reckless, rowdy, or rough behavior that <strong>in</strong>terferes with the safe or purposeful order of aschool or school-related activity.Illegal Organization Violation - establish<strong>in</strong>g or participat<strong>in</strong>g <strong>in</strong> a secret society or prohibited organization onSchool Board owned property, at a school function, or at a school sponsored extracurricular activity.Inappropriate or Obscene Act – the use of oral or written language, electronic messages, pictures, objects,gestures, or engag<strong>in</strong>g <strong>in</strong> unwelcome or <strong>in</strong>appropriate touch<strong>in</strong>g, or any other physical act that is considered to beoffensive, socially unacceptable, or <strong>not</strong> suitable for an educational sett<strong>in</strong>g.Inattentive Behavior - conduct that demonstrates a lack of engagement or attention <strong>in</strong> lessons or class activities,<strong>in</strong>clud<strong>in</strong>g, but <strong>not</strong> limited to, non-participation, putt<strong>in</strong>g head down on desk, napp<strong>in</strong>g or sleep<strong>in</strong>g <strong>in</strong> class.Insubord<strong>in</strong>ation - the refusal or failure to follow a direction or order from a school staff member, bus driver, orany other adult <strong>in</strong> authority at school.Larceny/Theft (S) – know<strong>in</strong>gly obta<strong>in</strong><strong>in</strong>g, possess<strong>in</strong>g, sell<strong>in</strong>g, us<strong>in</strong>g, dispos<strong>in</strong>g of or attempt<strong>in</strong>g to obta<strong>in</strong>,possess, sell, use or dispose of the property of a<strong>not</strong>her with <strong>in</strong>tent to either temporarily or permanently deprive theother person of their property or benefit from the property or appropriate the property to his or her own use or tothe use of any person <strong>not</strong> entitled to the use of the property without the permission or consent of the owner orperson lawfully <strong>in</strong> possession of the property.Ly<strong>in</strong>g/Misrepresentation - <strong>in</strong>tentionally provid<strong>in</strong>g false or mislead<strong>in</strong>g <strong>in</strong>formation to, or withhold<strong>in</strong>g valid<strong>in</strong>formation from, a school staff member or any other adult <strong>in</strong> authority at school.8Page 541
