Students attend<strong>in</strong>g Sem<strong>in</strong>ole <strong>County</strong> Public <strong>Schools</strong> have the right to a free and appropriate education, which<strong>in</strong>cludes the right to equal educational opportunities without regard to race, national orig<strong>in</strong>, gender, disability, ormarital status. Students are also vested with other fundamental rights. Among these are the rights to:1. a safe and orderly environment <strong>in</strong> which to learn;2. be treated with dignity and respect;3. reasonably express op<strong>in</strong>ions and personal po<strong>in</strong>ts of view;4. peaceably assemble;5. be secure <strong>in</strong> their personal privacy;6. limit access to their student records;7. be <strong>in</strong>formed of the rules of conduct; and8. reasonable and fair treatment.Note:These rights are <strong>not</strong> absolute and are more restricted at school than when students are <strong>in</strong> a public placeor engaged <strong>in</strong> activities <strong>not</strong> associated with school. Any student behavior that substantially <strong>in</strong>terfereswith the orderly operation of the school is prohibited and may subject the student to discipl<strong>in</strong>ary actionand crim<strong>in</strong>al prosecution.THREATS OF VIOLENCEStudents are prohibited from mak<strong>in</strong>g direct or <strong>in</strong>direct threats of violence aga<strong>in</strong>st <strong>in</strong>dividuals or gro<strong>up</strong>s. Anythreat of such violence must be reported immediately to a teacher or school adm<strong>in</strong>istrator. All threats ofviolence (oral, written, electronic, or symbolic) will be reported to law enforcement and <strong>in</strong>vestigated by schoolofficials. A student found to have made a threat of violence is subject to appropriate discipl<strong>in</strong>ary consequences,<strong>up</strong> to and <strong>in</strong>clud<strong>in</strong>g: suspension, expulsion, arrest, and prosecution.Note:Note:Pursuant to Florida Statute 836.10 it is a second-degree felony for a person to communicate a writtenthreat to do bodily harm to a<strong>not</strong>her person.Pursuant to Florida Statute 790.162 it is a second-degree felony for a person to threaten to place ordischarge a destructive device with the <strong>in</strong>tent to do bodily harm.BULLYING AND HARASSMENTIt is the policy of the Sem<strong>in</strong>ole <strong>County</strong> School Board that all of its students, school district employees and schooldistrict volunteers have an educational sett<strong>in</strong>g that is safe, secure and free from harassment and bully<strong>in</strong>g of anyk<strong>in</strong>d. The School Board will <strong>not</strong> tolerate bully<strong>in</strong>g and harassment of any type. Conduct that constitutes bully<strong>in</strong>gand harassment, as def<strong>in</strong>ed here<strong>in</strong>, is prohibited.Bully<strong>in</strong>g means systematically and chronically <strong>in</strong>flict<strong>in</strong>g physical hurt or psychological distress on one or morestudents, a school district employee or a school district volunteer, <strong>in</strong>clud<strong>in</strong>g: unwanted and repeated written,verbal, or physical behavior, this <strong>in</strong>cludes any threaten<strong>in</strong>g, <strong>in</strong>sult<strong>in</strong>g, or dehumaniz<strong>in</strong>g gesture that is severe orpervasive enough to create an <strong>in</strong>timidat<strong>in</strong>g, hostile or offensive educational environment; cause discomfort orhumiliation; or unreasonably <strong>in</strong>terferes with the <strong>in</strong>dividual’s school performance or participation.Harassment means any threaten<strong>in</strong>g, <strong>in</strong>sult<strong>in</strong>g or dehumaniz<strong>in</strong>g gesture, use of data or computer software, written,verbal or physical conduct directed aga<strong>in</strong>st a student, school district employee or school district volunteer by astudent, school district employee or school district volunteer.Bully<strong>in</strong>g and Harassment <strong>in</strong>cludes cyber stalk<strong>in</strong>g which means to engage <strong>in</strong> a course of conduct to communicate,or to cause to be communicated, words, images, or language by or through the use of electronic mail or electroniccommunication, directed at a specific person, caus<strong>in</strong>g substantial emotional distress to that person and serv<strong>in</strong>g nolegitimate purpose, as def<strong>in</strong>ed by Florida Statute 784.048(1)(d). Cases of cyber stalk<strong>in</strong>g will be reported to lawenforcement.4Page 537
