UCPCF shall provide insurance coverage as required by its charter as issuedby OCSB and as otherwise required below:Insurance providing coverage against claims for compensatorydamages, costs, and attorney's fees brought under 42 U.S.C. 1983,Title VII, ADA, §504 of the Rehabilitation Act of 1973, or any otherstate or federal law, where such claims are not covered under theschool's general liability policy.Required insurance shall be documented by certificates of insurance,which provide that SCSB and OCSB shall be notified at least 45 daysin advance of cancellation, non-renewal or adverse change. Newcertificates of insurance shall be provided to SCSB and OCSB atleast 30 days prior to the effective date of the coverage therebydocumented. Upon request, the applicant will provide a completecopy of any insurance policy. The applicant, upon request of SCSBor OCSB, shall provide a statement as to the amount of claimspayments or reserves chargeable to the aggregate amount of policycoverage, as to commercial general liability coverage. The receipt ofcertificates of insurance or other documentation of insurance orpolicies or copies of policies by SCSB or OCSB, which indicate lesscoverage than required shall not constitute a waiver of therequirements herein stated. Proof of insurance shall be provided onor before 30 days from the date of approval of this Agreement by allparties.13. Financial records will be maintained by UCPCF as provided for in the manual"Financial and Program Cost Accounting and Reporting for Florida Schools."UCPCF shall provide an unaudited annual financial statement to the OCSB nolater than 45 days after the close of the fiscal year and an audited financialstatement no later than 75 days after the close of a fiscal year.14. UCPCF represents and warrants to the SCSB that it has read and is familiarwith Florida Statute Sections 1012.32, 1012.465, 1012.467, and 1012.468regarding background investigations. UCPCF covenants to comply with allrequirements of the above cited statutes and agrees to indemnify and holdharmless the SCSB, its officers, agents and employees from any liability inthe form of physical injury, death, or property damage resulting from theUCPCF's failure to comply with the requirements of this paragraph or FloridaStatute Sections 1012.32, 1012.465, 1012.467 and 1012.468.3Page 524
