Procedures: Any student who believes he/she has been discrim<strong>in</strong>ated aga<strong>in</strong>st or has been harassed by a<strong>not</strong>herstudent, employee, or non-employee (volunteer) may use the student grievance procedures or may compla<strong>in</strong>directly to the build<strong>in</strong>g pr<strong>in</strong>cipal or the District’s Educational Equity Coord<strong>in</strong>ator. The fil<strong>in</strong>g of a compla<strong>in</strong>t orotherwise report<strong>in</strong>g discrim<strong>in</strong>ation or harassment will <strong>not</strong> affect a student's status, extracurricular activities,future grades, or homework assignments.The right to confidentiality, both of the compla<strong>in</strong>ant and of the accused, will be respected, consistent with theSchool Board's legal obligations and with the necessity to <strong>in</strong>vestigate allegations of misconduct and takecorrective action when this conduct has occurred.In determ<strong>in</strong><strong>in</strong>g whether alleged conduct constitutes sexual/racial harassment, the totality of the circumstances, thenature of the conduct and the context <strong>in</strong> which the alleged conduct occurred will be <strong>in</strong>vestigated. TheS<strong>up</strong>er<strong>in</strong>tendent or designee has the responsibility of <strong>in</strong>vestigat<strong>in</strong>g and resolv<strong>in</strong>g compla<strong>in</strong>ts of sexual/racialharassment.Discipl<strong>in</strong>ary Action: a substantiated charge of discrim<strong>in</strong>ation or harassment on the part of a student shallsubject that student to discipl<strong>in</strong>ary action, which may <strong>in</strong>clude suspension or expulsion, consistent with theStudent Conduct and Discipl<strong>in</strong>e Code.STUDENT GRIEVANCE PROCEDURE(DISCRIMINATION)The student grievance procedure is solely limited to the questions and concerns that arise from Title IX of theEducation Amendments Act, that prohibits sex discrim<strong>in</strong>ation <strong>in</strong> education or the Florida Equity Act, whichprohibits discrim<strong>in</strong>ation <strong>in</strong> public education on the basis of race, national orig<strong>in</strong>, sex, disability, or marital statusof a student.Note:The student grievance procedure does <strong>not</strong> apply to the appeal of school discipl<strong>in</strong>ary actions; unless thestudent asserts that the discipl<strong>in</strong>ary sanctions are the result of discrim<strong>in</strong>ation, as def<strong>in</strong>ed by Title IX orthe Florida Equity Act.The follow<strong>in</strong>g steps shall be followed if a student feels that he/she has experienced discrim<strong>in</strong>ation at school:Level I: If the student believes that he/she has been discrim<strong>in</strong>ated aga<strong>in</strong>st, he/she may file a written compla<strong>in</strong>twith his/her school counselor or the District Equity Coord<strong>in</strong>ator. The school counselor or the District EquityCoord<strong>in</strong>ator will schedule a conference. The conference must be held with<strong>in</strong> five (5) school days of the date offil<strong>in</strong>g.Level II: If a student is <strong>not</strong> satisfied with the resolution made at Level I, he/she may appeal <strong>in</strong> writ<strong>in</strong>g to theappropriate build<strong>in</strong>g level adm<strong>in</strong>istrator (such as an assistant pr<strong>in</strong>cipal or dean) for an <strong>in</strong>formal conference anddiscussion of the grievance.Level III: If a student is <strong>not</strong> satisfied with the resolution made at Level II, he/she may appeal to the build<strong>in</strong>gpr<strong>in</strong>cipal <strong>in</strong> writ<strong>in</strong>g for an <strong>in</strong>formal conference and discussion of the grievance.Level IV: If a student is <strong>not</strong> satisfied with the resolution made at Level III and the grievance was filed due toalleged discrim<strong>in</strong>ation on the basis of race, color, national orig<strong>in</strong>, gender, disability, marital status, age, religion,or any other basis prohibited by law, he/she may appeal to the District’s Educational Equity Coord<strong>in</strong>ator byfollow<strong>in</strong>g the Educational Equity Compla<strong>in</strong>t/Grievance Procedure.
