have a detrimental effect on the orderly operation of a school, or to jeopardize the health, safety, or welfare ofstudents and staff members of a school.A student may be subject to school board authorized discipl<strong>in</strong>ary sanctions when he or she commits an act or actsaway and apart from school that can be shown to pose a threat or danger to the safety of other students, staff, orschool property and/or that the act or acts will prevent the orderly delivery of the <strong>in</strong>structional program at anyschool.STUDENTS SUBJECT TO AUTHORITY BY SCHOOL PERSONNELFlorida Statute 1003.31 establishes that all students enrolled <strong>in</strong> the Sem<strong>in</strong>ole <strong>County</strong> Public <strong>Schools</strong> are subjectto the law, rules, regulations, and policies of the State of Florida and the School Board of Sem<strong>in</strong>ole <strong>County</strong>,Florida, anytime:1. a student is on School Board owned property;2. a student is attend<strong>in</strong>g school;3. a student is on a school bus;4. a student is be<strong>in</strong>g transported to or from school or school-sponsored events; or5. a student is <strong>in</strong> attendance at or participat<strong>in</strong>g <strong>in</strong> a school-sponsored activity.6. school personnel have the right to question students concern<strong>in</strong>g school matters without <strong>not</strong>ice to orconsent of the student’s parent(s) or legal guardian.Dur<strong>in</strong>g such times, all students are subject to the immediate control and direction of district and school leveladm<strong>in</strong>istrators, deans, s<strong>up</strong>ervis<strong>in</strong>g teachers or other adults (such as chaperones), staff members, and school busdrivers.SEARCH AND SEIZURESchool personnel have the authority to conduct a warrantless search of a student's person, <strong>book</strong> bag, locker, motorvehicle, or any other storage area on School Board property, if school personnel have reasonable suspicion thatillegal, prohibited, stolen, or harmful items or substances may be concealed on the student or hidden there<strong>in</strong>. Asearch based on reasonable suspicion may be <strong>in</strong>itiated without <strong>not</strong>ice to or consent of the student or parent. Thestudent shall be <strong>in</strong>formed of the school personnel’s suspicions for conduct<strong>in</strong>g the search prior to the search be<strong>in</strong>g<strong>in</strong>itiated, unless there is a need to protect others from imm<strong>in</strong>ent danger or harm. The parent of a student who hasbeen searched shall be immediately <strong>not</strong>ified of the outcome of any search.AUTHORITY OF THE TEACHERFlorida Statute 1003.32 vests teachers and other school staff members with authority for the control anddiscipl<strong>in</strong>e of students on a school campus and <strong>in</strong> other places they are assigned to s<strong>up</strong>ervise students. Studentsare required to follow the lawful directions of all district or school level adm<strong>in</strong>istrators, teachers, school staffmembers and chaperones when on School Board owned property or at other places where they are under thes<strong>up</strong>ervision of School Board personnel.Teachers shall make every reasonable effort to control classroom disr<strong>up</strong>tions or misbehavior by students.However, if a disr<strong>up</strong>tion or misbehavior persists, or if the disr<strong>up</strong>tion is severe, the teacher shall direct the studentto an appropriate adm<strong>in</strong>istrator with a description of the <strong>in</strong>cident written on a referral form provided by theadm<strong>in</strong>istration.Note:Florida Statute 1003.32 and State Board Rule 6A-1.0404, and 6A-6.03312 authorize teachers and otherschool or school district personnel to file charges aga<strong>in</strong>st a student if a crime has been committedaga<strong>in</strong>st a teacher or other <strong>in</strong>structional personnel on school property, on school-sponsoredtransportation, or dur<strong>in</strong>g school-sponsored activities.2Page 535
