Notice is hereby given that use of a wireless communications device <strong>in</strong>cludes the possibility of the imposition ofdiscipl<strong>in</strong>ary action by the School Board or crim<strong>in</strong>al penalties if the device is used <strong>in</strong> a crim<strong>in</strong>al act.Notification of Rights Under the Protection of P<strong>up</strong>il Rights Amendment (PPRA)PPRA affords parents certa<strong>in</strong> rights regard<strong>in</strong>g our conduct of surveys, collection and use of <strong>in</strong>formation formarket<strong>in</strong>g purposes, and certa<strong>in</strong> physical exams. These <strong>in</strong>clude the right to:Consent before students are required to submit to a survey that concerns one or more of the follow<strong>in</strong>gprotected areas ("protected <strong>in</strong>formation survey") if the survey is funded <strong>in</strong> whole or <strong>in</strong> part by aprogram of the U.S. Department of Education (ED)-1. Political affiliations or beliefs of the student or student's parent;2. Mental or psychological problems of the student or student's family;3. Sex behavior or attitudes;4. Illegal, anti-social, self-<strong>in</strong>crim<strong>in</strong>at<strong>in</strong>g, or demean<strong>in</strong>g behavior;5. Critical appraisals of others with whom respondents have close family relationships;6. Legally recognized privileged relationships, such as with lawyers, doctors, or m<strong>in</strong>isters;7. Religious practices, affiliations, or beliefs of the student or parents; or8. Income, other than as required by law to determ<strong>in</strong>e program eligibility.Receive <strong>not</strong>ice and an opportunity to opt a student out of-1. Any other protected <strong>in</strong>formation survey, regardless of fund<strong>in</strong>g;2. Any non-emergency, <strong>in</strong>vasive physical exam or screen<strong>in</strong>g required as a condition of attendance,adm<strong>in</strong>istered by the school or its agent, and <strong>not</strong> necessary to protect the immediate health andsafety of a student, except for hear<strong>in</strong>g, vision, or scoliosis screen<strong>in</strong>gs, or any physical exam orscreen<strong>in</strong>g permitted or required under State law; and3. Activities <strong>in</strong>volv<strong>in</strong>g collection, disclosure, or use of personal <strong>in</strong>formation obta<strong>in</strong>ed from studentsfor market<strong>in</strong>g or to sell or otherwise distribute the <strong>in</strong>formation to others.Inspect, <strong>up</strong>on request and before adm<strong>in</strong>istration or use1. Protected <strong>in</strong>formation surveys of students;2. Instruments used to collect personal <strong>in</strong>formation from students for any of the above market<strong>in</strong>g,sales, or other distribution purposes; and3. Instructional material used as part of the educational curriculum.These rights transfer from the parents to a student who is 18 years old or an emancipated m<strong>in</strong>or under State law.SCPS will develop policies, <strong>in</strong> consultation with parents, regard<strong>in</strong>g these rights, as well as arrangements toprotect student privacy <strong>in</strong> the adm<strong>in</strong>istration of protected <strong>in</strong>formation surveys and the collection, disclosure, oruse of personal <strong>in</strong>formation for market<strong>in</strong>g, sales, or other distribution purposes. SCPS will directly <strong>not</strong>ify parentsof these policies at least annually at the start of each school year and after any substantive changes. SCPS willalso directly <strong>not</strong>ify, such as through U.S. Mail or email, parents of students who are scheduled to participate <strong>in</strong>the specific activities or surveys <strong>not</strong>ed below and will provide an opportunity for the parent to opt his or her childout of participation of the specific activity or survey. SCPS will make this <strong>not</strong>ification to parents at the beg<strong>in</strong>n<strong>in</strong>gof the school year if the District has identified the specific or approximate dates of the activities or surveys at thattime. For surveys and activities scheduled after the school year starts, parents will be provided reasonable<strong>not</strong>ification of the planned activities and surveys listed below and be provided an opportunity to opt their childout of such activities and surveys. Parents will also be provided an opportunity to review any pert<strong>in</strong>ent surveys.Follow<strong>in</strong>g is a list of the specific activities and surveys covered under this requirement:• Collection, disclosure, or use of personal <strong>in</strong>formation for market<strong>in</strong>g, sales orother distribution; •Adm<strong>in</strong>istration of any protected <strong>in</strong>formation survey <strong>not</strong>funded <strong>in</strong> whole or <strong>in</strong> part by ED; and• Any non-emergency, <strong>in</strong>vasive physical exam<strong>in</strong>ation or screen<strong>in</strong>g as described above.Parents who believe their rights have been violated may file a compla<strong>in</strong>t with:33Page 568
