Notification of Rights under FERPA and § 1002.22, Fla. Stat.for Elementary and Secondary <strong>Schools</strong>The Family Educational Rights and Privacy Act (FERPA) affords parents and students over 18 years of age("eligible students") certa<strong>in</strong> rights with respect to the student's education records. These rights are:(1) The right to <strong>in</strong>spect and review the student's education records with<strong>in</strong> 45 days of the day the Schoolreceives a request for access.Parents or eligible students should submit to the School pr<strong>in</strong>cipal [or appropriate school official] a written requestthat identifies the record(s) they wish to <strong>in</strong>spect. The School official will make arrangements for access and <strong>not</strong>ifythe parent or eligible student of the time and place where the records may be <strong>in</strong>spected.(2) The right to request the amendment of the student’s education records that the parent or eligible studentbelieves are <strong>in</strong>accurate, mislead<strong>in</strong>g, or otherwise <strong>in</strong> violation of the student’s privacy rights underFERPA.Parents or eligible students who wish to ask the School to amend a record should write the School pr<strong>in</strong>cipal [orappropriate school official], clearly identify the part of the record they want changed, and specify why it should bechanged. If the School decides <strong>not</strong> to amend the record as requested by the parent or eligible student, the Schoolwill <strong>not</strong>ify the parent or eligible student of the decision and advise them of their right to a hear<strong>in</strong>g regard<strong>in</strong>g therequest for amendment. Additional <strong>in</strong>formation regard<strong>in</strong>g the hear<strong>in</strong>g procedures will be provided to the parent oreligible student when <strong>not</strong>ified of the right to a hear<strong>in</strong>g.(3) The right to privacy of personally identifiable <strong>in</strong>formation <strong>in</strong> the student's education records, except tothe extent that FERPA and state law authorizes disclosure without consent.One exception, which permits disclosure without consent, is disclosure to school officials with legitimateeducational <strong>in</strong>terests. A school official is a person employed by the School as an adm<strong>in</strong>istrator, s<strong>up</strong>ervisor,<strong>in</strong>structor, or s<strong>up</strong>port staff member (<strong>in</strong>clud<strong>in</strong>g health or medical staff); a person serv<strong>in</strong>g on the School Board; aperson or company with whom the School has outsourced services or functions it would otherwise use its ownemployees to perform (such as an attorney, auditor, medical consultant, or therapist); a parent or student serv<strong>in</strong>gon an official committee, such as a discipl<strong>in</strong>ary or grievance committee; or a parent, student, or other volunteerassist<strong>in</strong>g a<strong>not</strong>her school official <strong>in</strong> perform<strong>in</strong>g his or her tasks, or an authorized representative of a state federalagency conduct<strong>in</strong>g an audit or enforcement activity <strong>in</strong> conjunction with any federal or state program.A school official has a legitimate educational <strong>in</strong>terest if the official needs to review an education record <strong>in</strong> orderto fulfill his or her professional responsibility.Upon request, the School discloses education records without consent to officials of a<strong>not</strong>her school district <strong>in</strong>which a student seeks or <strong>in</strong>tends to enroll, or is already enrolled if the disclosure is for purposes of the student’senrollment or transfer. [(4) The right to file a compla<strong>in</strong>t with the U.S. Department of Education concern<strong>in</strong>g alleged failures by theSchool to comply with the requirements of FERPA.
