For each SCSB student placed at UCPCF pursuant to this Agreement, UCPCFwill report said student to OCSB to be counted for funding from the FloridaEducation Finance Program (FEFP), in the manner and at the time requiredby OCSB.UCPCF will be responsible for any Medicaid billing for and on behalf of anySCSB students enrolled in UCPCF pursuant to this Agreement.No SCSB student placed at UCPCF under this Agreement shall be disciplinedby UCPCF except as provided for by law, including but not limited to IDEA, 20U.S.C. §1400, et seq. and applicable federal regulations, §504 of theRehabilitation Act of 1973, and applicable federal regulation, and §1006.07).No SCSB student shall be expelled from UCPCF except as provided for bylaw and only then by consent of SCSB. No student shall be separated orwithdrawn by UCPCF without the consent of SCSB. Such consent shall notbe unreasonably withheld. SCSB students enrolled at UCPCF under thisAgreement shall be subject to the OCSB Code of Student Conduct duringthe term of their enrollment at UCPCF.UCPCF will give immediate notice, in writing, to the Executive Director of ExceptionalStudent Education for SCSB of the withdrawal of any student placedpursuant to this Agreement by the student's parent, guardian, legalcustodian, or any other person.UCPCF shall exercise the same duty of care and supervision of SCSBstudents placed at UCPCF under the terms of this Agreement, as the SCSB isrequired to exercise for students enrolled in its schools.UCPCF shall immediately report all incidents involving injury, sexualmisconduct, known or suspected abuse (institutional or third party), assault,or criminal activity involving any student placed at UCPCF under thisAgreement to the Superintendent of Seminole County Public Schools, SCPS ExecutiveDirector for Exceptional Student Support Services, Risk Manager for SCSB,the OCSB Director of the Risk Management Department and to all appropriateinsurance carriers, as and in the manner required by law, and shall fully cooperatewith SCSB staff or any authorized third party representatives in the investigation ofany such incidents.11. UCPCF shall provide to the SCSB copies of all documents, papers, letters orother material made or received in conjunction with this Agreement, subjectto State and Federal law regarding confidentiality. UCPCF agrees to complywith all of the requirements of Section 1002.22, Florida Statutes, in thesame manner and to the same extent as any third party contracting with a2Page 523
