ZERO TOLERANCERecommendation for Expulsion Required: Students who are determ<strong>in</strong>ed by the School Board to havecommitted one of the follow<strong>in</strong>g violations as def<strong>in</strong>ed by Florida law or this code while on School Board owned,operated or ma<strong>in</strong>ta<strong>in</strong>ed property (<strong>in</strong>clud<strong>in</strong>g a school bus or other school or School Board vehicle) or while at aschool/School Board sponsored activity (whether on or off a school site or School Board owned, operated orma<strong>in</strong>ta<strong>in</strong>ed property).(a) Shall be recommended for expulsion from all Sem<strong>in</strong>ole <strong>County</strong> public schools for <strong>not</strong> lessthan one year:(1) Br<strong>in</strong>g<strong>in</strong>g or possess<strong>in</strong>g a firearm or weapon, as def<strong>in</strong>ed <strong>in</strong> Chapter 790 Fla. Stat., toschool, to any school function, or onto any school-sponsored transportation.Note: For the purposes of zero tolerance “weapon” means any dirk, knife, metallicknuckles, slung shot, billy club, tear gas gun, chemical weapon or device or otherdeadly weapon except a firearm or a common pocketknife, plastic knife, or bluntbladedtable knife.“Firearm” means any weapon (<strong>in</strong>clud<strong>in</strong>g starter gun) which will, is designed to, ormay readily be converted to expel a projectile by the action of an explosive; theframe or receiver of any such weapon; any firearm muffler or silencer; anydestructive device; or any mach<strong>in</strong>e gun. The term firearm does <strong>not</strong> <strong>in</strong>clude anantique firearm unless the antique firearm is used <strong>in</strong> the commission of a crime.(2) Mak<strong>in</strong>g a threat or false report, as def<strong>in</strong>ed by ss. 790.162 and 790.163, respectively,<strong>in</strong>volv<strong>in</strong>g a school or school personnel’s property, school transportation, or a schoolsponsoredactivity.Upon recommendation by the S<strong>up</strong>er<strong>in</strong>tendent, the School Board may assign students who aredeterm<strong>in</strong>ed to have committed any of the above offenses to an alternative assignment under such termsand conditions as shall be determ<strong>in</strong>ed by the School Board <strong>in</strong> lieu of expulsion. If a student committ<strong>in</strong>gany zero tolerance offenses is a student who has a disability, the School Board shall comply withapplicable State Board of Education rules.Any student found to have committed a violation of s. 784.011(1), (2), or (3) shall be expelled orplaced <strong>in</strong> the district alternative school or other alternative program as deemed appropriate. Uponbe<strong>in</strong>g charged with an offense under s. 784.011(1), (2), or (3), the student shall be immediatelyremoved from his or her school of regular attendance and placed <strong>in</strong> the district alternative school, orother alternative program as deemed appropriate and as required by s. 1006.13(4).TOBACCO VIOLATIONS AND CIVIL PENALTIESFlorida Statute 569.12 authorizes school officials to be designated as Tobacco Product EnforcementOfficers and authorizes them to issue civil citations that are filed with the Clerk of the Court for theCircuit Court of the 18 th Judicial Circuit <strong>in</strong> Sem<strong>in</strong>ole <strong>County</strong>, Florida. Students found to be guilty of atobacco violation (FS 386.212 or FS 569.11) are subject to penalties that <strong>in</strong>clude monetary f<strong>in</strong>es,community service, and revocation of driv<strong>in</strong>g privileges <strong>in</strong> addition to discipl<strong>in</strong>e sanctions as provided bythis code.SUSPENSION OR DELAY OF DRIVING PRIVILEGESFlorida law authorizes the Department of Highway Safety and Motor Vehicles to suspend the driver’s license ordelay the issuance of a driver’s license to anyone if they:1. are convicted of the possession, sale, or conspiracy to possess a controlled substance (FS 322.055).11Page 544
