LEGAL NOTICES1. Illegal use, possession, or sale of controlled substances, as def<strong>in</strong>ed <strong>in</strong> chapter 893, by any student while thestudent is <strong>up</strong>on school property or <strong>in</strong> attendance at a school function is grounds for discipl<strong>in</strong>ary action by theschool and may result <strong>in</strong> crim<strong>in</strong>al penalties be<strong>in</strong>g imposed.2. Use of a wireless communications device <strong>in</strong>cludes the possibility of the imposition of discipl<strong>in</strong>ary action bythe school or crim<strong>in</strong>al penalties if the device is used <strong>in</strong> a crim<strong>in</strong>al act. A student may possess a wirelesscommunications device while the student is on school property or <strong>in</strong> attendance at a school function. Note:Possession and use of wireless communications devices <strong>in</strong>cludes but <strong>not</strong> necessarily limited to: cellphone, electronic telephone pager, personal digital assistant [PDA] when used for wirelesscommunication of any type, and like devices.3. The possession of a firearm or weapon as def<strong>in</strong>ed <strong>in</strong> chapter 790, Florida Statutes, by any student while thestudent is on school property or <strong>in</strong> attendance at a school function is grounds for discipl<strong>in</strong>ary action and mayresult <strong>in</strong> crim<strong>in</strong>al prosecution.4. Violence aga<strong>in</strong>st any district school board personnel by a student is grounds for out-of-school suspension,expulsion, or imposition of other discipl<strong>in</strong>ary action by the school and may result <strong>in</strong> crim<strong>in</strong>al penalties be<strong>in</strong>gimposed.5. Violation of district transportation policies, <strong>in</strong>clud<strong>in</strong>g disr<strong>up</strong>tive behavior on a school bus by a student isgrounds for suspension of the student’s privilege of rid<strong>in</strong>g on a school bus and may be grounds fordiscipl<strong>in</strong>ary action by the school and may also result <strong>in</strong> crim<strong>in</strong>al penalties be<strong>in</strong>g imposed.6. Violation of the district school board’s sexual harassment policy by a student is grounds for <strong>in</strong>-schoolsuspension, out-of-school suspension, expulsion, or imposition of other discipl<strong>in</strong>ary action by the school andmay also result <strong>in</strong> crim<strong>in</strong>al penalties be<strong>in</strong>g imposed.7. Any student who is determ<strong>in</strong>ed to have brought a firearm or weapon, as def<strong>in</strong>ed <strong>in</strong> Florida Statutes Chapter790, to school, to any school function, or onto any school-sponsored transportation, or to have possessed afirearm at school, shall be recommended for expulsion, with or without cont<strong>in</strong>u<strong>in</strong>g educational services, fromthe student’s regular school for a period of <strong>not</strong> less than one full year and referred to the crim<strong>in</strong>al justice ofjuvenile justice system. The School Board may assign the student to a discipl<strong>in</strong>ary program or second chanceschool for the purpose of cont<strong>in</strong>u<strong>in</strong>g educational services dur<strong>in</strong>g the period of expulsion. The S<strong>up</strong>er<strong>in</strong>tendentmay consider the one-year expulsion requirement on a case-by-case basis and request the School Board tomodify the requirement by assign<strong>in</strong>g the student to an alternative school or program or second chanceschool.8. Any student who is determ<strong>in</strong>ed to have made a threat or false report, as def<strong>in</strong>ed by ss. 790.162 and 790.163,respectively, <strong>in</strong>volv<strong>in</strong>g school or school personnel’s property, school transportation, or a school-sponsoredactivity will be recommended for expulsion, with or without cont<strong>in</strong>u<strong>in</strong>g educational services, from thestudent’s regular school for a period of <strong>not</strong> less than one full year and referred for crim<strong>in</strong>al prosecution. TheSchool Board may assign the student to a discipl<strong>in</strong>ary program or second chance school for the purpose ofcont<strong>in</strong>u<strong>in</strong>g educational services dur<strong>in</strong>g the period of expulsion. The S<strong>up</strong>er<strong>in</strong>tendent may consider the oneyearexpulsion requirement on a case-by-case basis and request the district school board to modify therequirement by assign<strong>in</strong>g the student to an alternative school or program or second chance school.9. Students are entitled to a review of suspensions, adm<strong>in</strong>istrative assignments, and assignments made by ahear<strong>in</strong>g officer <strong>in</strong> lieu of suspension accord<strong>in</strong>g to the procedures set forth <strong>in</strong> the Discipl<strong>in</strong>e ProceduresManual.STATUTORY NOTICEA student may possess a wireless communications device, <strong>in</strong>clud<strong>in</strong>g but <strong>not</strong> limited to a cell phone, electronictelephone pager, personal digital assistant (PDA), when used for wireless communication of any type, or a likedevice, while the student is on a school campus or while be<strong>in</strong>g transported by a school bus, but it may <strong>not</strong> be exposedor create a disr<strong>up</strong>tion.A wireless communications device, <strong>in</strong>clud<strong>in</strong>g but <strong>not</strong> limited to a cell phone, electronic telephone pager, personaldigital assistant (PDA) when used for wireless communication of any type, or a like device, shall <strong>not</strong> be used whilethe student is on a school campus dur<strong>in</strong>g the <strong>in</strong>structional day or while be<strong>in</strong>g transported by a school bus. The term“on campus dur<strong>in</strong>g the <strong>in</strong>structional day” shall <strong>in</strong>clude participation <strong>in</strong> a field trip or other <strong>in</strong>structional activity thatmay take place off campus. The term “transportation by a school bus” shall <strong>in</strong>clude transportation for a field trip orother <strong>in</strong>structional activity, either by a district school bus or a commercial carrier.32Page 567
