107A Reconstructive Approach to Law Ipoint, morality and lawdifferprimafacie inasmuch as posttraditionalmorality represents only a form of cultural knowledge, whereas lawhas, in addition to this, a binding character at the institutional level.Law is not only a symbolic system but an action system as well.The empirically informed view that modern legal orders are acoeval complement of autonomous morality no longer fits with theplatonistic notion that law and morality are related by a kind ofimitation-as if the same geometric figure were simply projectedon a different level of presentation. Hence we must not understandbasic rights or Grundrechte, which take the shape of constitutionalnorms, as mere imitations of moral rights, and we must not takepolitical autonomy as a mere copy of moral autonomy. Rather,norms of action branch out into moral and legal rules. From anormative point of view, this corresponds to the assumption thatmoral and civic autonomy are co-original and can be explainedwith the help of a parsimonious discourse principle that merelyexpresses the meaning of postconventional requirements of justification.Like the postconventional level of justification itself-thelevel at which substantial ethical life dissolves into its elementsthisprinciple certainly has a normative content inasmuch as itexplicates the meaning of impartiality in practical judgments.However, despite its normative content, it lies at a level of abstractionthat is still neutral with respect to morality and law, for it refersto action norms in general:D: Just those action norms are valid to which all possibly affectedpersons could agree as participants in rational discourses.This formulation contains some basic terms that require elucidation.The predicate "valid" (gi1ltig) pertains to action norms and allthe general normative propositions that express the meaning ofsuch norms; it expresses normative validity in a nonspecific sensethat is still indifferent to the distinction between morality andlegitimacy) I understand "action norms" as temporally, socially, andsubstantively generalized behavioral expectations. ! include among"those affected" (or involved) anyone whose interests are touchedby the foreseeable consequences of a general practice regulated bythe norms at issue.
