Offentlighedskommissionens betænkning – Kapitel 28
In Chapter 24 of the white paper the question is addressed of the extent to
which the authorities should be obliged to publish certain types of documents
on their websites regularly and on their own initiative.
Chapter 25 of the white paper contains the Commission’s deliberations regarding
the question of whether a duty should be laid down in the Access to Public
Administration Files Act to file the documents of administrative authorities,
i.e. that the documents are subjected to regular, systematic registration in a
register or the like. In addition, the issue is addressed of whether the Ministry
of Justice as the responsible authority for the Access to Public Administration
Files Act should set up a public access portal on the Internet containing laws,
administrative rules and regulations, draft Bills and statements by the Ombudsman
of the Folketing (Danish Parliament) concerning access to documents.
Chapter 26 of the white paper deals with the question of the extent to which the
Commission’s draft of a new Access to Public Administration Files Act would
give rise to amendments in the specific rules pertaining to access to documents
etc. contained in the Public Administration Act, the Health Act, the Environmental
Information Act, the Act on Processing of Personal Data, the Archives
Act and the Administration of Justice Act.
Chapter 27 of the white paper contains the Commission’s draft of a new, comprehensive
Access to Public Administration Files Act with comments on the
individual provisions of the draft.
3. The Principal Elements of the Commission’s Draft Bill
As mentioned above under point 1, the Commission has drawn up a draft of a
new, comprehensive Access to Public Administration Files Act, which is presented
in Chapter 27 of the white paper. In the following, the principal elements
of the draft Bill that are new in relation to the present Access to Public Adminis
tra tion Files Act are reviewed.
3.1. Objects Clause
The Commission proposes that a provision be inserted in the Danish Access
to Public Administration Files Act that, with a point of departure in the Act’s
