received or dispatched, as well as a brief thematic description of the document’s<br />

content (Draft Bill, Section 15(3)).<br />

3.7. Duty to Provide Active Information<br />

It is proposed that ministerial departments, subordinate agencies and directorates,<br />

independent councils and boards as well as the central administration<br />

in municipalities and regions shall provide information on their Internet websites<br />

to the general public about their activities, so-called active information<br />

(Draft Bill, Section 17).<br />

In particular with respect to the expenditures and activities of Ministers,<br />

there is agreement in the C<strong>om</strong>mission that this information should be published.<br />

In this regard, a minority of the C<strong>om</strong>mission (9 members) have proposed<br />

that the duty of Ministers to provide active information be codified in law,<br />

whereby the Access to Public Administration Files Act (Draft Bill, Section<br />

17) stipulates partly that ministerial departments must on their Internet website<br />

provide information to the general public about Ministers’ expenditures,<br />

activities and gifts received, and partly that the Minister for Justice should lay<br />

down specific guidelines concerning the above-mentioned information provision<br />

requirement.<br />

A majority of the C<strong>om</strong>mission (12 members) find, however, that in light of<br />

the political agreement behind the existing provision in Section 2(1), Point 2 regarding<br />

the introduction of an openness scheme concerning the expenditures<br />

and activities of Ministers, the agreement parties should have the possibility to<br />

adjust it when necessary to meet the changing needs of the times.<br />

3.8. Public Access Portal<br />

In the draft Bill, it is proposed that the Danish Ministry of Justice should establish<br />

and maintain a so-called public access portal on the Internet which contains<br />

specific information about access to official documents kept by public<br />

administration authorities. This portal should in this regard contain laws, administrative<br />

provisions, parliamentary bills as well as the Folketing Omsbudman’s<br />

statements regarding right of access to official documents kept by public<br />

administration authorities (Draft Bill, Section 18).<br />
