the heritable right of the six merk land of Batok [Beattock], tlie "kind-<br />

ness " of two and a half merks land in Greenhill, and one merk land in<br />

40. Agreement between John Johnstone of that Ilk ou the one part, and the<br />

"aidd tennentis " of the lands of Kclhead, that they shall render him<br />

daily service, v.ith multure, "beir" and kaiu fowls, and other payments,<br />

while he shall warrant and defend them at all hands having interest<br />

during the lifetime of his sister, Jean Johnstone, lifertntrix of the lands.<br />

binding themselves to refer any action or cause cf controversy amongst<br />

them to the decision of Robert Johnstone in Cairnsalloch, and eleven<br />

other Johu.stones, as " amiable freiudis cqualie chosin be the rest," with<br />

John Johnstone of that Ilk, their '' chief and maister," as oversman, and<br />

to abide by any deliverance given by them. And if any one named<br />

Johnstone refuse to do thi.s, they shall be punisheil by the others. This
