terms of a decree of exemption in favour of the late Sir John Johnstone,<br />

father of Sii- James, granted by the lords of session, etc. Given under<br />

the quarter seal, at Ilolyrood-house, 10th June 1500, 55<br />

59. Bond by William Johnstone and others, principal men of the Jolmsfonos of<br />

Jlillbank and Anchinsloek, that because Sir James Johnstone of Duns-<br />

kellic, knight, and Robert Douglas of Cosehogill are cautioners for them,<br />

they \YiU relieve the king and his wardens for all attempts committed or<br />

to be committed ; and because their chief is obliged to keep Robert<br />

Douglas skaithless, they bind themselves to free and relieve Sir James of<br />

all prejudice that may arise from his act of caution. Subscribed at<br />

Dinwoudie-green, 3d November 1500. 56<br />

GO. Extract act of the Justiciary Court held at Dumfries on 16th Xovember<br />

1590, by Sir John Carmichael of that Ilk, knight, warden of the west<br />

inarch, narrating that James Johnstone of that Ilk had presented his men<br />

before the warden, and objected to the repledging asked by the ]",arl. of<br />

Morton as steward of Aunandale. He also wished it declared that the<br />

judge allowed him to poind for relief of his caution, and he protested that<br />

he and his .servants when decerned to pay goods, although they were<br />

innocent, might have relief against the culprits, 58<br />

CI. Agreement between John, Earl of Morton, Lord Maxv.ell, .itc., for himself, his<br />

, kin and friends on the cue part, and Sir James Johnstone of Dunskellie,<br />

knight, for him.^elf, his kin and friends, on the other part. Both parties<br />

oblige themselves that iieither of them shall assure or agree with Sir James<br />

Douglas of Drumlanrig, knight, his kin and friends, without the consent<br />

of the other, and that both agreements shall be maile on one Jay ; and if<br />

either party have an action against Sir James or his kiu, they bind them-<br />

selves to assist each other against him, etc. Dated and subscribed by<br />

both parties at Dumfries, 13th March 1592-3. Witnesses, Robert<br />
