Argyll were examined, but Annandale is not mentioned as one of tliem.^<br />

On 23d April 1G62 the king granted to the Earl of Annandale and Hart-<br />

fell a crown charter under the sign-manual and groat seal. The warrant for<br />

the charter, which is still preserved, shovrs that it had been intended to be<br />

completed at the same time as the patent for the peerages.^ The limitation of<br />

heirs in the charter is in favour of James, Earl of Annandale and Hartfell,<br />

Viscount of Annan, Lord Johnstone of Lochwood, Lochmabeu, Moffatdale,<br />

and Evandale, and the heirs-male of his body, which failing, to the heirs-<br />

female of his body, without division, and heii'S-male of the body of the said<br />

eldest heir-female, carrying the name and arms of Johnstone, which failing,<br />

to the earl's nearest lawful heirs whatsoever, of the lauds and barony of<br />

Johnstone, Corrie, Knock, Newbic, barony of Moffatdale, and the heritable<br />

office of keeper of the king's castle of Lochmaben, with the fees and other<br />

dues thereunto belonging.<br />

The king also by that new charter granted to the earl, and the heirs-male<br />

of his body, whom failing, to the heirs-female of his body, without division,<br />

and the heirs-male of the body of his eldest heir-female, wiiich failing, to<br />

his nearest and law ful heirs whatsoever, the lauds, lordships, baronies, aud<br />

others therein specified, which the king also thereby erected, created aud<br />

incorporated into a free barony, lordship, and earldom, regality aud justiciary,<br />

to-be called the earldom of Annandale and Hartfell, and lordship of John-<br />

stone, with the title, style, and dignity of an earl, according to the date of<br />

the patent granted to the earl and his father. The king also thereby erected<br />

the town aud territory of iloflat into the burgli of barony and regality of ^Moffat.<br />
