Tills bond indicates virtually a new outbreak of the fjud between John-<br />

stone and ]\ra.\v.c-ll. The latter, vho had been in ward, was liberated in<br />

December 1579 on his promise to behave himself as a dutiful subj.ect, and to<br />

assist the warden in preserving the jieace. But not long afterwards, at a fray<br />

in Dumfries, two of his relatives assaulted Johnstone of Carusallocl: "to the<br />

effusion of his bluid in gret qnantitie," and as one of the Maxwells was<br />

also hurt, Jolni Johnstone and Lord Ma.xwell Mere both charged by the<br />

privy coinicil to subscribe a mutual assurance to be entered into by botli<br />

parties and their friends.^ This aj.'parently was dune, but only a few weeks<br />

later Johnstone complained to the council that Jlaw^xdl had brolceu the<br />

assurance and had convened the king's lieges "in weiilyke maner." The<br />

case was continued for proof, but no record of the matter is preserved, and on<br />

2nd September LjiSO they urutually signed another assurance to last for si.x<br />
