[He appoints William, Lord Johnstoun, his eldest lawful son, to be his only<br />

executor, universal legator, and sole intromitter with his whole goods, etc.] " Item,<br />

I make, nominal and constitute Lady Hcnricta Dowglas, my spouse, and the<br />

Iiight Honorable William, iJuke of Hamiltoun, William, Erie of Quenisberrie,<br />

and William, Erie of Dundouald, my beloved frciuds, and in caice of our said<br />

spous, her deccis, or mariag, the said William, in her vice and place, to be tutors<br />

testamentars to the said William, Lord Johnstoun, my soue, and to Jolm, Georg,<br />

Henrieta, and Anna Johustounes, my other childrcnc who ar within the yeires<br />

of tutorie." [Three of them to be a quorum. lie appoints Eobert, Lord Maxwell,<br />

John, Lord Lindsnj', blaster of Carmichaell of Tlyndfoord, Sir Eichard Graham<br />

of Nelhcrbie, Sir Eobert Sinclare of Longformakhous, advocate, and John John-<br />

stoun of Poiltouu, bailie of Edinburgh, "to be overseirs to my said eldest sone<br />

and remanent childrene." Rescinds all former testaments and concludes:] "Thir<br />

presentis ar VTitten be John Mure, wryter to his Majesteis signet, and subscryved<br />

with my hand at the Caunogaite, the daj' of Aprylle, the ycire of God j^vj"<br />

The earl's indisposition continued, and he consulted eminent medical men<br />

in Edinburgh, in reference to his attacks of ague and hectic fever. One of<br />

-these doctors prepared a full .statement of his case on 17th June 1G72,<br />

in the hope of promoting his lordship's recovery and preservation, which<br />

the practitioner adds is of so great concernment not only to his own noble<br />

family, but even to the vrhole nation.<br />

Exactly one month after the anxious consideration by the medical<br />

adviser, the earl died on 17th July 1072. His lordship previous to his death<br />
