special master in all his actions against all men, the king and their own<br />

James Johnstone of Duaskellic, kuiglit, and have " borrowit " or bailed<br />

themselves upon their own bonds, they therefore bind themselves to re-<br />

enter to the house of the Lochwood on the Stli of January, there to remain<br />

till lawful entry be taken of them ; and in the meantime they shall not<br />

trouble Sir James or his friends, civilly or eriniinally. At the Lochwood,<br />

C4. Proposals by Sir James Johnstone of that Ilk and of DunskclHe, knight,<br />

who stated that, considering God's glory, the king's peace and the common<br />

veal, perceiving great trouble to arise from " the last vnhapjiy and<br />

Tugodly wark" between Lord Maxwell and himself, which led to that<br />

lord's death, he had buried all resentment, and made an agreement with the<br />

late Lord Maxwell, who however had made another private bond designed<br />

to ruin Johnstone and his friends, which was likely to disturl) the borders.<br />

To avoid this Johnstone oifers to give security that neither he nor anj- of<br />

his partisans in the late trouble .shall do harm in taking goods from any<br />

partakers with the late Lord i\Iaxwell, he and his friends having a similar<br />

surety. If any goods be taken unwittingly from the Maxwells he<br />

promises to give redress ; and further offers to submit the matter to<br />

arbitoi-s. Dated at the Lochwood, 30th June l.")94, 61<br />

be made in due form to Sir James Johnstone of Duuskellie, knight, for<br />

the treasonable .slaughter of the late John, Lord Maxwell, lieutenant of<br />

the west marches for the time, and other pcnsons in his comjiany, on 6th<br />

December last, 1593, and for all actions that may follow thereon. Date<br />
