iiilieiited tlic estale.i Adam Johustone was defendant in an action against
liini as brother and heir of tlie late John Johustone of that ilk." In 149
ho was reqiiiied by the lords of council to reconipeiise to Tassy (Eustace)
JMa.wvell twenty-one slieep valued at -Is. Gd. each, which had been cari'ied off
by a certain John Johustone, for whom he was surety.'
At a later date, iu 1-1-98, Adam Johustone was concerned in a more
serious aflair, being one of the leaders of a band of sixty men wlio made an
attack on the liouse of Glendiuning iu Eskdale. The laird of Glendinniug
was sheriff of Eskdale, aud private revenge may have prompted the outrage,
but Johustone and his accomplices arc charged with seizing the place " under
silence of night," and committing consideiablc depredation. They forcibly
entered the building and carried off four horses, fourteen cows and oxen,
with bedding, napery, silver spoons, ]")ots, pans, and other goods, to the value
of 100 mcrks. It would appear that the horses were valued at £-10, aud that
two candlesticks aud a goblet were among the spoils. The marairders were
summoued before the lords of council, but it does not appear that they were
punished, though seiuc compensation appears to have been given.*
Various appearan.ces made by Adam Johustone before the lords of
council vere not on his own account, but ars surety for delincjuent members
where he is re(|iured as the surety for certain ciausmen to restore to Thomas
Porteous of Hawkshaw forty-eight cows valued at forty shillings each,
seveu liorses and mares each worth the same sum, aud goods va.lued at £-10,
