<strong>Orange</strong> <strong>Guide</strong> – Chapter 17: State Laws: HCP <strong>and</strong> State Employee Restrictions<br />

The value of the following items are not included when calculating the annual aggregate limit:<br />

Starters;<br />

Fair market value payments for services, such as speaking <strong>and</strong> consulting payments;<br />

RC-approved promotional literature such as clinical reprints <strong>and</strong> slim jims;<br />

Independent educational grants (financial support for continuing education forums);<br />

Financial support for educational scholarships; <strong>and</strong><br />

<strong>Pfizer</strong> RC-approved educational items with retail value of less than $25.<br />

All colleagues who engage in activities in California should be aware that their expenditures which meet<br />

the criteria above will be included when calculating the annual aggregate limit. Colleagues must ensure<br />

that their records on these expenditures are accurate <strong>and</strong> complete.<br />

The State of California can impose significant penalties on <strong>Pfizer</strong> for failure to comply with this law. If<br />

you have any questions concerning the California Pharmaceutical Sales <strong>and</strong> Marketing Disclosure Law,<br />

please contact the Regional Attorney with responsibility for California.<br />

Colorado<br />

The Law: Restrictions on Gifts to State Employees<br />

Colorado law prohibits any state employee from soliciting, accepting, or receiving, directly or indirectly,<br />

any gift or other item of value (including meals), regardless of form (e.g., money, service loan, travel,<br />

entertainment, hospitality, or promise) worth more than $50 in any calendar year.<br />

As with any other customer, colleagues may not provide any type of gift, regardless of value, to a<br />

Colorado state employee if the gift is intended or expected to influence or reward that employee in the<br />

performance of any activity related to his or her official duties.<br />
