<strong>Orange</strong> <strong>Guide</strong> – Chapter 17: State Laws: HCP <strong>and</strong> State Employee Restrictions<br />

under one of the permitted consulting engagements, <strong>and</strong> who is receiving compensation for<br />

services pursuant to a contract with <strong>Pfizer</strong>. These types of meals are not considered a “gift” under<br />

the state statute. Similarly, gifts (as defined above) to practitioners are also prohibited.<br />

You must make a good faith effort to determine whether a practitioner is licensed in Minnesota. To<br />

help you determine whether a practitioner holds a Minnesota license, you can check the HCP Lookup<br />

List available on Opsource under the State Healthcare Law Compliance tab. Sales Colleagues can also<br />

access this information on PfieldNet under the Compliance Tab or by looking up the HCP on their iCUE<br />

tablet.<br />

Minnesota can impose significant penalties on <strong>Pfizer</strong> as well as criminal misdemeanor penalties for<br />

failure to comply with this law. If you have any questions concerning the Minnesota Gift Law, please<br />

contact the Regional Attorney with responsibility for Minnesota.<br />

Helpful Points<br />

Colleagues must not offer or give any gift of value to a Minnesota HCP, including educational items.<br />

Colleagues must not provide meals or refreshments to Minnesota HCPs.<br />

There is an exception for meals provided as a reasonable expense to a practitioner in connection<br />

with serving on the faculty at a <strong>Pfizer</strong> professional or educational conference or meeting, or<br />

performing bona fide services under one of the permitted consulting engagements, <strong>and</strong> who is<br />

receiving compensation for services pursuant to a contract with <strong>Pfizer</strong>, <strong>and</strong> for snacks provided at a<br />

booth at a conference or seminar.<br />

Colleagues must not engage Minnesota HCPs as consultants, except under the limited<br />

circumstances detailed in this Chapter.<br />

You are required to make a good faith effort to determine whether an HCP is licensed in Minnesota<br />

before providing a gift or a meal to the HCP. You can consult PfieldNet or Opsource for a list of<br />

Minnesota HCPs.<br />

The meal <strong>and</strong> gift restrictions apply even when a Minnesota HCP is located in another state.<br />
