<strong>Orange</strong> <strong>Guide</strong> – Chapter 17: State Laws: HCP <strong>and</strong> State Employee Restrictions<br />

All types of food <strong>and</strong> beverages (including nominal ones such as coffee, drinks, etc.) are<br />

limited to in-office or in-hospital settings during promotional presentations.<br />

The restriction also applies to interactions with Massachusetts HCPs that occur outside of<br />

Massachusetts.<br />

There is a limited exception for meals provided as compensation to Massachusetts HCPs<br />

who are consulting pursuant to a bona fide contract with <strong>Pfizer</strong>. In addition, refreshments<br />

such as coffee <strong>and</strong> snacks provided by <strong>Pfizer</strong> at a booth at a convention/congress are also<br />

permissible.<br />

Important Notice Regarding Meals in MA:<br />

On July 8, 2012, the governor of Massachussetts signed legislation that allows for the provision of<br />

certain out-of-office meals to MA-licensed HCPs under certain conditions <strong>and</strong> subject to new<br />

tracking <strong>and</strong> reporting requirements. Until further notice from Legal, the restrictions described<br />

above remain in effect for purposes of <strong>Pfizer</strong> policy.<br />

Other Prohibited Items of Value <strong>and</strong> Activities<br />

Generally, educational items may be provided to Massachusetts licensed HCPs as long as they are RC-<br />

approved.<br />

Colleagues are prohibited from making expenditures on behalf of any Massachusetts HCP for:<br />

Entertainment or recreational items of any value;<br />

Grants, scholarships, subsidies or educational items offered with the intent to encourage or<br />

modify prescribing behavior; or<br />

Residents, fellows <strong>and</strong> HCPs to attend educational conferences (where funding comes<br />

directly from <strong>Pfizer</strong> <strong>and</strong> <strong>Pfizer</strong> chooses the recipient).<br />
