<strong>Orange</strong> <strong>Guide</strong> – Chapter 17: State Laws: HCP <strong>and</strong> State Employee Restrictions<br />

Specifically, costs associated with the following activities are required to be reported:<br />

Direct-to-consumer advertisements targeting D.C. residents;<br />

Educational or informational programs, materials, or seminars provided to healthcare<br />

professionals, pharmacies, clinics, health plans <strong>and</strong> other healthcare providers;<br />

Remuneration for promoting or participating in educational or informational sessions;<br />

Food, entertainment, gifts, <strong>and</strong> anything else provided to HCPs valued at more than $25 or<br />

provided for less than market value;<br />

All expenses associated with HCP trips <strong>and</strong> travel;<br />

Starters (unless they are for distribution to patients at no charge); <strong>and</strong><br />

The aggregate cost of all employees <strong>and</strong> contractors engaging in drug advertising <strong>and</strong><br />

promotion in D.C.<br />

The following marketing expenses do not have to be reported:<br />

Expenses of $25 or less;<br />

Compensation for bona fide clinical trial activities; <strong>and</strong><br />

Scholarships <strong>and</strong> expenses for attending educational, scientific, or policy conferences if<br />

attendee is selected by the sponsoring organization.<br />

Payments to DC licensed HCPs for participating in blinded market research,, if a) the<br />

research is conducted by an “independent survey research organization;” b) the<br />

pharmaceutical client does not know the identity of the practitioners participating in the<br />

research; <strong>and</strong> c) the payments are determined <strong>and</strong> made by the survey research<br />

organization.<br />

Definition of Healthcare Professional<br />

The law applies to expenditures provided to persons <strong>and</strong> entities who are licensed to provide healthcare<br />

in D.C., including healthcare professionals <strong>and</strong> persons employed by them who work in D.C., licensed<br />

insurance carriers, health plans <strong>and</strong> benefit managers, pharmacies, hospitals, nursing facilities, clinics<br />

<strong>and</strong> other entities licensed to provide health care in D.C.<br />
