The Law: Nevada Marketing Code of Conduct<br />

The Nevada Marketing Code of Conduct requires all manufacturers <strong>and</strong> wholesalers who sell or market<br />

a drug in Nevada to:<br />

New York<br />

Adopt a written marketing code of conduct (the current PhRMA Code is acceptable);<br />

Adopt a training program to provide regular training to appropriate employees on the<br />

marketing code of conduct;<br />

Conduct annual audits to monitor compliance with the marketing code of conduct;<br />

Adopt policies <strong>and</strong> procedures for investigating instances of noncompliance with the<br />

marketing code of conduct;<br />

Identify a compliance officer responsible for the marketing code of conduct; <strong>and</strong><br />

Submit certain information annually to the Nevada State Board of Pharmacy (including the<br />

marketing code of conduct, description of the training program; description of the<br />

investigation policies; contact information for the Compliance Officer; <strong>and</strong> certification of<br />

the company’s annual audit <strong>and</strong> compliance with its marketing code of conduct).<br />

The Law: Restrictions on Gifts to State <strong>and</strong> Local Officers <strong>and</strong> Employees<br />

New York prohibits all NY elected officials, state officers <strong>and</strong> employees, state legislators, state<br />

legislative employees, municipal officers <strong>and</strong> municipal employees from receiving (directly or indirectly)<br />

any gift. “Gift” includes anything of value given in any form, including any money, service, loan, travel,<br />

entertainment, hospitality, or promise, unless an exception applies. Colleagues may not provide any<br />

item to a New York State or local officer or employee if the item is intended or expected to influence or<br />

reward the New York State or local officer or employee in the performance of any activity related to his<br />

or her official duties.<br />
