Colleagues must accurately record <strong>and</strong> track in iCUE the distribution of these items to any HCPs.<br />

Marketing <strong>and</strong> other HQ teams developing these programs must abide with the other<br />

parameters outlined in the Massachusetts Update on Loosened Co-pay, Coupon <strong>and</strong> Free Trial<br />

Voucher restrictions, dated August 8, 2012.<br />

Non-patient Identified Prescriber Data<br />

Before using non-patient-identified prescriber data, <strong>Pfizer</strong> must give Massachusetts HCPs the<br />

opportunity to request that their prescriber data be withheld from Sales <strong>and</strong> Marketing <strong>and</strong> not be used<br />

for marketing purposes. The Commercial Operations group within <strong>Pfizer</strong> is responsible for ensuring<br />

that any prescriber data provided by <strong>Pfizer</strong> to Sales representatives complies with state law.<br />

Minnesota<br />

The Law: Gift Restriction Law<br />

Minnesota prohibits <strong>Pfizer</strong> from offering or giving any gift of value to a Minnesota healthcare<br />

practitioner. The definition of “gift” includes anything or service that is given <strong>and</strong> received for less than<br />

fair market value unless it is specifically permitted under the statute. The restrictions apply to all<br />

colleagues (not only Sales) <strong>and</strong> extend to interactions with Minnesota practitioners that occur outside<br />

of Minnesota.<br />

The following are not considered “gifts” under the statute <strong>and</strong> may be given to Minnesota practitioners:<br />

Free drug samples for free distribution to patients;<br />

Payment to sponsor a medical conference, professional meeting, or other educational<br />

program, provided no payment is made directly to a practitioner;<br />

Reasonable fees <strong>and</strong> expenses of a practitioner who serves on the faculty at a professional or<br />

educational conference or meeting;<br />
