1.8.2.4 Quami Ekta Week<br />
As per directions of “National Foundation<br />
for Communal Harmony”, CEA observed the<br />
Quami Ekta Week from 19 th to 25 th November,<br />
2009. The employees of CEA donated<br />
generously towards the fund for the physical and<br />
psychological rehabilitation of child victims of<br />
communal/ caste/ ethnic/ terrorist violence.<br />
1.8.3 Associations/ Unions in CEA<br />
The following Associations/ Unions of<br />
employees in CEA were active during 2009-10.<br />
i) Power Engineers Association- Under<br />
process for recognition under CCS (RSA)<br />
Rules, 1993.<br />
ii) Drawing Staff Association – Recognized for<br />
three year under CCS (RSA) Rules, 1993.<br />
1.8.4 Pension Cases<br />
1.8.4.1 Pension Cases (Superannuation/<br />
VRS including sanction of CGEGIS<br />
amount)<br />
93 regular superannuation cases, 3 VRS<br />
cases, 5 death cases and 5 provisional pension<br />
cases have been settled during the year 2009-<br />
2010 and necessary payment of retirement<br />
benefits has been released. In addition, 80<br />
(approx.) more revised pension cases were also<br />
settled subsequent to revision of Pay/ Pay Scale<br />
due to 6 th Pay Commission.<br />
1.8.4.2 Transfer of Capitalized Value of<br />
Pensionary Benefits<br />
6 cases of transfer of capitalized value<br />
in respect of ex-employees of CEA who have<br />
been permanently absorbed in Government<br />
Undertakings/ Autonomous Bodies were<br />
processed and finalized where CEA has<br />
discharged its pensionary liabilities to the<br />
concerned organizations. 31 more such cases are<br />
under various stages of process.<br />
1.8.4.3 Restoration of one-third commuted<br />
portion of Pension/ grant of Family<br />
Pension<br />
Subsequent to issue of revised instructions/<br />
guidelines by the Deptt. of Pension & Pensioner’s<br />
Welfare for calculation of 1/3 rd restored amount<br />
of commuted portion of pension and subsequent<br />
to 6 th CPC, 45 cases relating to revision of the<br />
restored amount of 1/3 rd portion of pension and<br />
grant of family pension to the beneficiaries have<br />
been settled.<br />
1.8.4.4 Pro-rata pension (CAT/ Court Cases)<br />
17 cases of grant of pro-rata and<br />
other pensionary benefits to ex-employees<br />
of CEA permanently absorbed in PSUs who<br />
had approached the CAT/Court for relief<br />
were processed. Out of these, 2 cases where<br />
judgments were passed, have been settled and<br />
requisite payments released as directed by the<br />
Hon’ble CAT/Court. One (1) more such case<br />
for releasing pro-rata pensionary benefits is<br />
under process. In one (1) case, the judgment of<br />
the Hon’ble CAT required the Department to<br />
consider the claim of the applicant for pro-rata<br />
pensionary benefits and issue suitable orders. In<br />
this case, the Department considered the claim<br />
of the applicant and finding him ineligible for<br />
pro-rata pensionary benefits, issued requisite<br />
speaking order to him. In 3 cases where<br />
judgments were received, the Department/<br />
Government has filed “Appeal” in the Hon’ble<br />
Supreme Court and Delhi High Court and the<br />
cases are still sub-judice. Three (3) cases have<br />
been dismissed by the Hon’ble CAT. Seven (7)<br />
cases are still sub-judice in the Hon’ble CAT.<br />
In one (1) case, where representation claiming<br />
pro-rata pensionary benefits was received<br />
in this office, the matter was considered in<br />
consultation with the Ministry of Power and the<br />
requisite speaking order refusing the claim of<br />
the applicant has been issued.<br />
