Length <strong>of</strong> the right <strong>of</strong> way for communication as existing on<br />
1 st April shall be considered for calculation <strong>of</strong> revenue<br />
sharable for the period 1st April to 30th September and that<br />
existing on 1st October for the period from 1st October to<br />
31st March <strong>of</strong> the relevant financial year. The Commission<br />
has adopted a normative formula for revenue sharing<br />
because it is simple to apply and obviates the necessity <strong>of</strong><br />
getting into the actual pr<strong>of</strong>it and loss account <strong>of</strong> the<br />
company’s telecom business.<br />
The revenue calculated by applying the specified rate shall<br />
be utilised towards reduction <strong>of</strong> transmission charges<br />
payable by the beneficiaries <strong>of</strong> those assets in proportion to<br />
the transmission charges payable by them to the<br />
transmission owner and shall be adjusted on monthly basis<br />
for the bills <strong>of</strong> the respective month.<br />
4. Show Cause Notices to UP and J&K States for<br />
Failing to Pay UI Dues<br />
Central Electricity Regulatory Commission (CERC) issued<br />
show cause notices to Uttar Pradesh <strong>Power</strong> Corporation<br />
Ltd (UPPCL) and <strong>Power</strong> Development Department, (PDP),<br />
Govt. <strong>of</strong> J&K to explain by November 25 th , 2007 as to why<br />
action should not be initiated against them for recovery <strong>of</strong><br />
outstanding dues on account <strong>of</strong> unscheduled inter-change<br />
(UI) charges. It has come to the notice <strong>of</strong> Commission that<br />
principal amount <strong>of</strong> Rs.577.99 Crs and Rs. 410.25 Crs was<br />
outstanding against UPPCL and PDD (J&K), respectively<br />
for the period up to 2.9.2007. The arrears would further<br />
increase after addition <strong>of</strong> interest on the outstanding principal<br />
amount. The Commission has also observed that both <strong>of</strong><br />
these entities have been defaulting in payment <strong>of</strong> UI charges<br />
in the past as well.<br />
The capacity charge and energy charge components <strong>of</strong> tariff<br />
cover only scheduled energy and any excess drawal is paid<br />
for only through UI mechanism. Non-payment <strong>of</strong> UI charges<br />
therefore amounts to extracting energy from the grid without<br />
paying for it.<br />
The Commission noticed with concern that UPPCL and PDD<br />
(J&K) have been continuously overdrawing from the grid<br />
and on account <strong>of</strong> non-payment <strong>of</strong> UI charges, the<br />
outstanding UI payments are growing at alarming level, and<br />
urgent remedial action is required.<br />
5. Grant <strong>of</strong> Transmission licence to Jaypee <strong>Power</strong>grid<br />
Ltd.<br />
The Commission has granted transmission licence to<br />
Jaypee <strong>Power</strong>grid Ltd., a joint venture company promoted<br />
by Jaiprakash Hydro <strong>Power</strong> Ltd., (KHPL) and PGCIL, to<br />
undertake the business <strong>of</strong> establishing, commissioning,<br />
setting up, operating and maintaining the 400 kV<br />
transmission system comprising <strong>of</strong> the following elements:<br />
a) LILO <strong>of</strong> 400 kV D/C Baspa-Nathpa Jhri transmission<br />
line at Wanchoo;<br />
b) 400 kV D/C Kancham-Wangtoo-Abdullapur<br />
transmission line (quard conductor); and<br />
c) 400/220 kV sub station (extension) (PGCIL) at<br />
Abdullapur<br />
The transmission system is meant to evacuate power from a<br />
hydroelectric project, namely Kancham Wangtoo HEP is being<br />
developed by Jaiprakash Associates Ltd (JAL).<br />
6. Commission regulated the tariff <strong>of</strong> following six<br />
Central sector hydro power generating companies<br />
having an aggregate installed plant capacity <strong>of</strong><br />
7500 MW during the year 2006-07:<br />
i) National Hydro Electric <strong>Power</strong> Corporation Ltd.<br />
(2953 MW)<br />
ii) North Eastern Electricity <strong>Power</strong> Corporation Ltd.<br />
(755 MW)<br />
iii) Satluj Jal Vidyut Nigam Limited (1500 MW)<br />
iv) Narmada Hydro Development Corporation Ltd.<br />
(1000 MW)<br />
v) Tehri Hydro Development Corporation (500 MW).<br />
vi) Damodar Valley Corporation (144 MW)<br />
Commission dealt 28 petitions <strong>of</strong> the above hydro power<br />
generating companies during the year. These comprise <strong>of</strong><br />
15 petitions relating to approval <strong>of</strong> final generation tariff <strong>of</strong><br />
the existing hydro stations, approval <strong>of</strong> additional<br />
capitalization <strong>of</strong> previous tariff period, provisional tariff <strong>of</strong><br />
newly commissioned projects for the period 2004-09, 8<br />
petitions pertaining to review <strong>of</strong> Commission’s orders. Other<br />
petitions which have been dealt by the Commission are (i)<br />
Implementation <strong>of</strong> comprehensive scheme for dynamic<br />
inflow forecasting in respect <strong>of</strong> Chamera –I HEP by NHPC<br />
(ii) Implementation <strong>of</strong> ABT in respect <strong>of</strong> Indira Sagar Project<br />
(iii) Claim <strong>of</strong> SJVNL in respect <strong>of</strong> Capacity Index due to red<br />
alert in 2004-05, high silt conditions & flooding <strong>of</strong> satluj river<br />
in the year 2005-06 (iv) HPSEB petition for relaxation under<br />
Regulations 12 & 13 <strong>of</strong> CERC Tariff Regulations, 2004 in<br />
Nathpa Jhakri HE project (v) Final tariff <strong>of</strong> four out <strong>of</strong> total<br />
six units <strong>of</strong> Nathpa Jhakri HE project and four out <strong>of</strong> eight<br />
units <strong>of</strong> Indira Sagar HEP commissioned during the period<br />
2001-04.<br />
7. Inter-State Trading in Electricity<br />
The Commission had, so far, issued licence for inter-state<br />
trading in electricity to total 26 applicants. Of the total, 4<br />
licences have been issued during the current year 2007-08<br />
i.e. upto 30 th November, 2007. The CERC Order dated<br />
26.10.2006 the trading licence <strong>of</strong> GMR Energy Ltd has been<br />
cancelled for the reason that the company has opted for<br />
surrendering its trading licence for participation in the<br />
transmission business.<br />
